1. This petition has been filed by the petitioner with the following prayer:-
“i. Issue a writ of Certiorari or any other appropriate writ, order, or direction, quashing and setting aside the Charge Memorandum dated 09.12.2025 issued by the Deputy Inspector General, Range Headquarters, CRPF, Chandigarh, for initiating a disciplinary inquiry against the Petitioner;”
2. The challenge in this petition is primarily to the charge-sheet dated 09.12.2025 issued to the petitioner. The subject matter of the charge-sheet alleging that the petitioner had obtained the appointment on 02.09.1992 as a Constable (GD) fraudulently and dishonestly by submitting a false/forged caste certificate issued on 03.11.1991.
3. The petition reveals that the petitioner had received the Show Cause Notice from the respondents alleging that he has secured the appointment on the basis of a forged Schedule Tribe certificate on 29.09.2025. The petitioner has responded to the same and it is pursuant thereto that the charge-sheet dated 09.12.2025 has been issued.
4. Suffice to state that the respondents’ case is that they have made enquiries from Tehsildar, Mathura, District Magistrate, Mathura and District Magistrate Mirzapur as well. The said authorities have submitted their reports. In any case, the issue which arises for consideration for which the petition has been filed is whether the charge-sheet could have been issued by the respondents that too after 33 years.
5. Even otherwise, as the issue shall also be whether the Schedule Tribe caste certificate has been validly issued by the authorities, based on which the petitioner has secured appointment in the Central Reserve Police Force, we are of the view that appropriate shall be that the respondents be permitted to continue with the enquiry proceedings in accordance with law but no final order shall be passed on the report to be submitted by the Enquiry Officer after conducting the enquiry. Mr. Ali, on instructions, states that the enquiry shall be completed within three months
6. We grant liberty to the respondents to approach this Court by filing an application in the writ petition after culmination of the proceedings, resulting in submission of the report by the Enquiry Officer.
7. At this stage, Mr. Ali submits that the direction be given to the petitioner to cooperate in the conduct of the enquiry.
8. Mr. Bhargava states that the petitioner shall cooperate in the conduct of the enquiry to ensure that the same is completed within three months.
9. Re-notify on 28.04.2026.
