The application stands disposed of.

CRL.M.A. 1037/2026

1. The present application has been filed under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (BNSS) on behalf of the appellant seeking permission to travel abroad to New York (USA) from 22.01.2026 to 03.02.2026.

2. Issue Notice.

3. The learned Special Public Prosecutor appearing on behalf of the respondent accepts notice and submits that she has no objection to the present application.

4. For the reasons stated in the application and in view of the no objection given by the learned Special Public Prosecutor, the application is allowed and the appellant is permitted to travel New York (USA) from 22.01.2026 to 03.02.2026 subject to the following conditions:-

(i) He shall furnish FD for a sum of Rs. 40 Lakhs, i.e., Rs.20 Lakhs in CBI Case No.41/2020 and Rs.20 Lakhs in CBI Case No.

295/2019.

(ii) He shall inform the SHO and the learned Trial Court about his arrival to India mentioning the details of the places visited by him alongwith the other details of the itinerary within seven days of his arrival. The applicant/appellant shall also file a complete copy of his passport alongwith the copy of Visa before the trial court on his return.

(iii) His Advocate Mr. Faraz Maqbool shall undertake to accept notice from the Court/Investigating Officer, if any, on behalf of the applicant in his absence and shall further undertake that in case the presence of applicant is required during the aforesaid period he shall immediately intimate the applicant and the applicant shall return to India within 48 hours.

(iv) He shall intimate the trial court about his contact addresses where he would be staying and his contact numbers.

(v) He shall not commit any offence while on bail.

5. With the aforesaid directions, the application stands disposed of.
