% 22.12.2025 I.A. 32299/2025(seeking exemption from instituting pre-litigation mediation)
1. This is an application under Section 12A (1) of the Commercial Courts Act, 2015 read with Section 151 of the Code of Civil Procedure, 1908 [‘CPC’], filed by the Plaintiffs seeking exemption from instituting pre-
litigation mediation.
2. Having regard to the facts that the present suit contemplates urgent interim relief and in light of the judgement of the Supreme Court in Yamini Manohar v. T.K.D. Keerthi, (2024) 5 SCC 815, exemption from the requirement of pre-
institution mediation is granted to the Plaintiffs.
3. Accordingly, the application stands disposed of.
I.A. 32300/2025(seeking leave to file additional documents)
4. This is an application under Order XI Rule 1(4) of CPC [as amended by the Commercial Courts Act, 2015] read with Section 151 CPC, seeking leave to file additional documents within thirty (30) days.
5. The Plaintiffs, if they wish to file additional documents will file the same within thirty (30) days from today, and it shall do so strictly as per the provisions of the Commercial Courts Act and the Delhi High Court (Original Side) Rules, 2018 (‘DHC Rules’).
6. For the reasons stated in the application, the same is allowed.
7. Accordingly, the application is disposed of.
I.A. 32301/2025(seeking exemption from filing original/certified documents)
8. This is an application under section 151 CPC, seeking exemption from filing original/certified documents.
9. Subject to the Plaintiffs filing certified copies within a period of 30 days from today, exemption is granted for the present, failing which, the Plaintiffs will not be entitled to rely upon these documents.
10. Original documents shall be produced/filed at the time of Admission/Denial, if sought, strictly as per the provisions of the Commercial Courts Act, 2015 and the Delhi High Court (Original Side)
Rules, 2018.
11. The application is disposed of.
I.A. 32302/2025(seeking exemption from filing list of dates, synopsis and documents)
12. This is an application filed under Section 151 of CPC for exemption from filing list of dates, synopsis and documents with margin of 4 cms on left side and the typed copies of dim documents.
13. Subject to the Plaintiffs filing typed copies of dim documents within a period of 30 days from today, exemption is granted for the present, failing which, the Plaintiffs will not be entitled to rely upon these documents.
14. For the reasons stated in the application, exemption from filing list of dates, synopsis is granted.
15. This application is disposed of.
I.A. 32303/2025(seeking exemption from advance service to the Defendants)
16. The present application has been filed under Section 151 of CPC, on behalf of the Plaintiffs seeking exemption from service to the Defendants.
17. In view of the fact that the Plaintiffs have sought an ex parte ad- interim injunction along with the appointment of a Local Commissioner, the exemption from effecting service upon the Defendants at this stage is granted.
18. Accordingly, the application stands disposed of.
I.A. 32304/2025(seeking extension of time for filing Court fees)
19. This is an application filed under Section 149 read with Section 151 of the CPC, 1908 seeking extension of time for filing court fees.
20. Learned counsel for the Plaintiffs states that partial court fees have been deposited and the remaining court fees shall be deposited within three (3) days.
21. It is directed that the court fees certificate be deposited within one (1) week failing which the plaint shall stand rejected under Order VII Rule
11(b) CPC.
22. The application stands disposed of.
