3. This writ petition is filed on behalf of the Petitioner under Article 226
of the Constitution of India seeking the following reliefs:-
“a. Issue a writ, order, or direction in the nature of mandamus, or any
other appropriate writ, directing Respondent No. 2, Maxfort Public
School, Rohini to admit/enroll the Petitioner in the allotted class
(Nursery/Pre-School) for the Academic Session 2025–2026;
b. Direct Respondent No. 2, Maxfort Public School, Rohini, not to fill the
seat allotted to the Petitioner until the final disposal of the present
Petition;
c. Issue a writ, order, or direction in the nature of mandamus, or any other
appropriate writ, directing Respondent No. 2 to provide free books,
writing materials, and uniform to the Petitioner under the EWS/DG/CWSN
category, with immediate effect;

##PAGE2##d. In the alternate to prayer ‘A’, direct Respondent No. 2, Maxfort Public
School, Rohini to submit an undertaking to the effect of granting
admission to the Petitioner in the next academic session, subject to the
date of disposal of the current Writ Petition.”
4. Issue notice.
5. Counsels, as above, accept notice on behalf of the respective
Respondents.
6. Petitioner is a minor belonging to DG-OBC category and has
approached this Court through her mother for a direction to Respondent
No.2/Maxfort Public School (‘School’) to admit the Petitioner in Nursery/
Pre-School for the academic session 2025-2026, predicating her case on the
recommendation made by Respondent No.1/Directorate of Education
(‘DoE’) in favour of the Petitioner.
7. Ms. Shikha Sharma Bagga, learned counsel for Respondent No.2/
School submits that admission has been correctly denied to the Petitioner in
keeping with the Circular issued by DoE on 05.03.2025 laying down the
“Guidelines for verification of documents & admission under EWS/DG
Category students at entry-level (i.e., Nursery/KG/Class-1st) in Private
Un-aided Recognized School of Delhi under RTE Act, 2009 & DSEAR, 1973
by DoE, MCD & NDMC for the academic session 2025-26 selected through
Computerized Draw of lots”. It is urged that as per the list in Clause 2 of the
Circular, Petitioner was required to submit various documents which
included legal guardianship certificate, if applicable. In the application/
registration form, Petitioner filled the name of one Priyanka as the legal
guardian of the Petitioner, however, subsequently, a letter was received from
the father of the Petitioner stating that Priyanka was not the legal guardian
and if the information given in the form was wrong, the admission be

##PAGE3##cancelled. Owing to the fact that false information was furnished in the
registration form, the School has cancelled the admission of the Petitioner. It
is pointed out that the Circular dated 05.03.2025 provides that the allotment
of the school shall be cancelled in case there is a discrepancy in the
information furnished in the registration form.
