1. This is a suit filed for permanent injunction restraining infringement

of trademarks, passing off, rendition of accounts, damages, and other

ancillary reliefs.

Factual Matrix

2. The Plaintiff is a part of the Inter IKEA Group, and is the owner of

the IKEA Concept and IKEA Retail System. It is engaged in the business of

well-designed, functional and affordable home furnishing products,

accessories, stationery, running and managing retail stores, restaurant

services and much more, all of which are carried out under the trademark

IKEA and [‘Plaintiffs mark’].

3. The mark IKEA was adopted by the Plaintiff in 1995 as an essential

and integral part of its domain name www.ikea.com, which has been

accessible to people around the world inculding India, since 1998. The

Plaintiff is the registered proprietor of a number of IKEA trademarks in

English and in the vernacular.

4. The Plaintiff has registration for the wordmark IKEA bearing TM no.

2499130 in class 7, application dated 2499130. It also has registration for

the device mark bearing TM no. 1523574 in class 20,

application dated 15.01.2007. Details of Plaintiff’s various registrations have

been set out in paragraph ‘17’ of the plaint.

5. The Plaintiff’s worldwide IKEA retail sales in the year 2022 were

44.6 billion Euros.

Overview of the Defendants

6. Defendant No.1/Jin Hua Zhang and Defendant No.2/AT are

phishing/scamming websites [‘infringing Defendants’].

7. Defendant No.3/NameSilo LLC is the Domain Name Registrar

[‘DNR’] for Defendant No.1.

8. Defendant No.4/Namecheap Inc. is the DNR for Defendant No.2.

9. Defendant Nos. 5 and 6 are the Department of Technology [DoT] and

the Ministry of Electronics and Information Technology [MeitY],

respectively.

10. Defendant Nos. 3 to 6 are hereinafter referred to as the ‘proforma

Defendants’.

Infringement by the Defendants

11. The Plaintiff came across a Facebook advertisement offering an

electric scooter for sale under the Plaintiff’s mark on the website

https://www.cyberxg.top/. Subsequently, the Plaintiff discovered a second

website, https://www.hotxg.top/, and in May 2023, a third website,

https://www.xbay.top/ [ ‘Defendant No. 1’s impugned websites’].

The initial two impugned websites were registered on 07.02.2023 by

Defendant No.3 and contain tabs at the bottom, such as ‘About Us’, etc.;

however, none of them are functional, and upon clicking ‘Contact Us’, the

user is redirected to a non-functional page.

12. Defendant No. 1’s impugned websites had a modus operandi wherein

allegedly products which are identical to the Plaintiff’s products were being

allegedly offered for sale. Additionally, the Plaintiff’s mark through images

is prominently displayed on the website. A user would be misled to believe

that the products offered through these websites are Plaintiff’s products.

13. On 30.03.2023, the Plaintiff placed an order from

https://www.hotxg.top/; however, to date, no product or refund has been

received.

14. In May 2023, the Plaintiff came across the website

https://www.abovei.site/, [‘Defendant No.2’ impugned website’] which
