Permission to travel abroad during the pendency of legal proceedings may be granted subject to stringent conditions, including security deposits and undertakings, to ensure the party's return and compliance with court orders.

O R D E R

(permission to travel from 29/12/2025 to 06/01/2026)

1. The present application has been filed by the applicant/petitioner seeking permission to travel to Bangkok from 29.12.2025 to 06.01.2026. The said request is pursuant to the permission already granted to the petitioner by this Court vide order dated 17.11.2025, whereby, the applicant/petitioner was permitted to undertake travel to Singapore from 19.11.2025 to 07.12.2025 and 22.12.2025 to 12.01.2026, subject to the conditions stipulated therein.

2. The said order dated 17.11.2025 reads as under:-

1. The present application has been filed by the applicant/ petitioner seeking permission to travel to Singapore from 19.11.2025 to 07.12.2025 and 22.12.2025 to 12.01.2026.

2. The application makes reference to the previous order dated 03.02.2025, passed in these proceedings, whereby the applicant/petitioner was allowed to travel to Singapore.

3. Learned counsel appearing on behalf of the petitioner submits that the applicant/petitioner undertook the aforesaid travel in scrupulous compliance with the conditions imposed by this Court.

4. There is no controversy as regards the applicant/petitioner having completed her travel as permitted vide the aforementioned orders, in compliance with the conditions laid therein.

5. While opposing the present application, learned counsel for the respondents submits that in case the petitioner/applicant is granted permission to travel, the same be subject to the same conditions, as imposed by this Court on previous occasion.

6. In the circumstances, considering the previous order passed by this Court, the applicant/ petitioner is permitted to undertake the proposed travel, subject to the following conditions:

(i) The petitioner shall deposit, by way of a security, a Fixed Deposit Receipt (FDR) amounting to Rs. 5,00,000/- with the Registrar of this Court, which shall be kept on auto-renewal mode.

(ii) The petitioner shall file an undertaking giving the details of the immovable properties that he owns and undertake that he shall not dispose of the same during the pendency of the present petition.

(iii) The petitioner shall file a detailed affidavit disclosing his complete itinerary, including his stay at various locations abroad as well as telephone numbers and residential/ hotel addresses. He shall also file an undertaking that he shall strictly adhere to the itinerary mentioned in the affidavit and not visit any other stations. He shall also furnish a copy of the air tickets purchased by him before the Registrar General.

(iv) The petitioner shall also provide the contact numbers that he would use during the period of stay abroad, and at least one of the said contact number will be kept operational at all times, subject to all fair exceptions, including the period he is on board the aircraft.

(v) The petitioner shall file an undertaking before the Registrar that he shall return to the country in terms of itinerary filed before the Registrar General. The petitioner shall intimate the Registrar General of this Court before leaving and within 72 hours of his return.

(vi) The petitioner shall file a self-attested copy of his passport along with a copy of his visa in the Court on his return to India.

(vii) The permission to travel abroad given in this order shall be subject to other applicable conditions and will not be deemed as a direction to any other authority.

(viii) The petitioner shall furnish an undertaking that upon his return to India, he shall participate in any proceedings against him and that he shall be bound down by any orders tha
