1. The hearing has been done through hybrid mode.

2. The present petition has been filed by the Petitioner seeking release of her gold jewellery being three gold kadas of 18 karat, weighing 63 grams, 2 gold rings of 18 karat and 21 karat, respectively, weighing 4.75 grams and 10 grams, respectively and one gold kada of 21 karat weighing 53.85 grams (hereinafter, ‘the detained articles’).

3. The case of the Petitioner is that she is a citizen of Afghanistan and had travelled to India on 19th December, 2020 with her husband for medical purposes. Both were travelling on medical visas. Upon her arrival at the IGI Airport,thedetainedarticleswereseizedfromheranda detention receipt dated

19th December, 2020 was issued.

4. According to the Petitioner, the detained articles were worn by her in routine and were thus, her personal effects. Ld. Counse
