O R D E R

1. The present petition has been filed by the petitioner seeking that respondent no. 2, 5 and 7 be directed to establish a hospital in terms of the order dated 25.07.2019 passed in W.P.(C) 6466/2013. The said order reads as under:

“1. This Public Interest Litigation has been preferred with the following prayers :

“a. That a Writ of Mandamus or any appropriate Writ or direction may kindly be passed in favour of the Petitioner and against the Respondents thereby directing the Respondents to remove difficulties, technical hurdles in cooperation with each other in establishing the hospital at the land earmarked by the respondents falling in Khasra No. 21/15/2 (4-07) and Kh. No.21/6 (6-11), as per the allotment made by the Respondent No. 3 vide letter dated

31.01.2012.

b. That a Writ of Mandamus or any other appropriate Writ or direction may kindly be passed in favour of the Petitioner and against the Respondents thereby directing the Respondent DDA to change the land use from residential to Public purpose as per Master Plan - 2021, enabling the Respondent no. 4 to establish the hospital.

c. That a Writ of Mandamus or any other appropriate Writ or direction may kindly be passed in favour of the Petitioner and against the Respondents thereby directing the Respondent No.4 Health Deptt to obtain necessary permission/sanction from the concerned department for establishing the Hospital at the land allotted to it by Panchayat Deptt.

d. Any other relief which this Hon'ble Court deems fit and proper in the facts and circumstances of the case may kindly be passed in favour of the Petitioner Association and against the Respondents.”

Having heard Counsel for both sides and looking to the facts and circumstances of the case, it appears that upon the plot in question which is Khasra No. 21/15/2 (4-07) and plot bearing Khasra No. 21/6 (6-11) which were earmarked for the establishment of the Hospital and which were allotted by the Respondent No.3 vide their letter dated 31st January, 2012 the construction of the Hospital has not yet taken place and on the contrary there are some religious encroachments for which an order dated 25th May, 2018 was passed by this Court in this writ petition and the report of the Religious Committee was set off.

3. Learned Counsel appearing for Respondents No. 2 to 5 and 7 submits that now the Religious Committee has already given a report dated 26th April, 2019 to the effect that the respondent can go ahead with the construction. The report of Religious Committee, placed before us, is taken on record.

4. In view of the submission of Counsel for Respondents No.2 to 5 and 7, we hereby direct the concerned respondent more particularly to Respondents No. 5 and 7 to go ahead with the construction for establishment of the Hospital at the land narrated hereinabove as early as possible and practicable, in accordance with law, rules, regulations and Government policy, applicable to the facts of the case.

5. With these observations, this writ petition is hereby disposed of.”

2. Learned counsel for respondent no. 2 to 5 and 7, submits that on a review petition filed against the aforesaid order dated 25.07.2019, the following order dated 17.10.2025 has been passed:

“1. There is no appearance on behalf of the original petitioner Sangam Vihar Vikas Manch, though it was represented on the last two dates of hearing.

2. Mr. Abhinav Sharma, learned Counsel appearing for the review petitioner-GNCTD, submits that, owing to various operational and technical hurdles, it is not possible to construct a hospital at the land in question. However, he subm
