1. This application has been filed on behalf of the defendant no.4 under Order I Rule 10(2) of the Code of Civil Procedure, 1908 (hereinafter ‘CPC’)

seeking deletion from the array of parties.

2. Notice in the present application was issued to the non-applicants on

17^th July, 2023.

3. Reply has been filed on behalf of the plaintiff.

4. It is the case of the applicant that no averments in the plaint have been made against the defendant no.4 nor have any reliefs been claimed against the said defendant. Therefore, the defendant no.4 is neither a
