1. The present application under Order XVI Rule 1(2) and (3) read with Section 151 Code of Civil Procedure, 1908 [“CPC”] read with Section 137/138 of the Indian Evidence Act, 1872 [“IEA”] has been filed by the Defendants for summoning of a witness from the office of Sub-Registrar, Kashmere Gate, Delhi.

2. Learned Counsel for the Defendants states that he does not intend to press this Application at this juncture, with liberty to take such steps as may be available to the Plaintiffs under law, including filing a fresh application at an appropriate stage.

3. The application is disposed of as not pressed.

1. The present application under Section 165 of the IEA read with Section 151 of the CPC has been filed by the Defendants to direct the Plaintiffs to make a statement on oath before this Court, regarding the alleged general power of attorneys dated 22.07.1995.

2. Learned Counsel for the Defendants states that he does not intend to press this Application at this juncture, with liberty to take such steps as may be available to the Plaintiffs under law, including filing a fresh application at an appropriate stage.

3. The application is disposed of as not pressed.

1. The present applications under Section 151 of the CPC has been filed on behalf of the Plaintiffs.

2. Since the LRs of deceased/Defendant No.1 have already been impleaded by way of the Order dated 25.02.2024, the present applications have been rendered as infructuous.

3. Accordingly, the present applications are disposed of as infructuous.

1. It is stated by the learned Counsels for the Plaintiffs and the Defendants that the last of the proceedings before the Local Commissioner for recording of the evidence of the Plaintiffs was held on 07.01.2020. Nearly six years have passed since then. The Local Commissioner is requested to start recording the evidence of the witnesses of the Plaintiffs as expeditiously as possible.

2. The parties are directed to approach the Local Commissioner within five days from today and the Local Commissioner is requested to commence the recording of the evidence in the first week of January, 2026.
