The present application under Order XVI Rule 1(2) and (3) read with Section 151 Code of Civil Procedure, 1908 [“CPC”] read with Section 137/138 of the Indian Evidence Act, 1872 [“IEA”] has been filed by the Defendants for summoning of a witness from the office of Sub-Registrar, Kashmere Gate, Delhi.

2. Learned Counsel for the Defendants states that he does not intend to press this Application at this juncture, with liberty to take such steps as may be available to the Plaintiffs under law, including filing a fresh application at an appropriate stage.
