% 11.12.2025 EX.APPL.(OS) 1816/2025 (seeking defreezing of bank accounts)

1. This application has been filed on behalf of the judgment debtor seeking a direction to defreeze the bank accounts of the judgment debtor set out in paragraph 3 of the present application, which are also reproduced below for sake of convenience:

3. Notice is accepted by counsel appearing on behalf of the decree holder.

4. Reply be filed within six (6) weeks.

5. Rejoinder thereto, if any, be filed within three (3) weeks thereafter.

6. It is the contention of the decree holder that other than the sum of Rs. 52,00,000/- which is covered by the demand draft, there is a further sum of about Rs. 40,00,000/- which is due to the decree holder.

7. Mr. Ashish Mohan, senior counsel appearing on behalf of the judgment debtor, submits that even though the judgment debtor disputes the aforesaid statement of the decree holder, he is willing to secure an amount of Rs.40,000,000/-.

8. He further submits that the judgment debtor shall ensure that a minimum sum of Rs. 40,00,000/- is available in the bank account no.00710570261, ICICI Bank, Green Park Branch (IFSC: ICIC0000071).

9. For the said purpose, the judgment debtor is permitted to transfer amounts from the remaining bank accounts detailed in paragraph 1 above to the ICICI Bank account. For the limited purpose of making the aforesaid transfer, the bank accounts at serial numbers (b), (c) and (d) in paragraph 1 above are ordered to be defreezed.

10. Once the judgment debtor has ensured that there is a minimum balance of Rs. 40,00,000/- in the ICICI Bank account and a lien of Rs. 40,00,000/- is marked on the said bank account, the bank accounts detailed in paragraph 1 above shall be defreezed as an interim measure.

11. List on 16^th March, 2026, the date already fixed.
