1. The present writ petition seeks removal of the Petitioner’s name from the Surveillance Register, History Sheeter and Bad Character record maintained by the Delhi Police.

2. From the record, it emerges that the Petitioner was previously involved in four criminal cases, the last of which was registered in the year 2020 and is presently pending trial before the concerned Court. The details of these cases are as follows:

3. The History Sheet of a criminal is opened under Rule 23.8 of the Punjab Police Rules, 1934. Personal files of persons for whom History Sheets are opened are maintained in accordance with PPR 23.13. PPR 23.13(4) which provides, “To prevent the undue accumulation of useless personal files, the Superintendent may, at his discretion, order the destruction of the personal file of any person of whom a History Sheet does not exist when such person has been of good behaviour continuously for seven years and the up-keep of his personal file appears unnecessary.”

4. The entering and deletion of names in the Surveillance Register is governed by Standing Order No. 54/2022.

5. The Status Report notes that the Petitioner has previously been involved in offences such as hurt, theft and snatching. On 28th September, 2022, the Petitioner’s History Sheet was opened under Bundle-A.

Mr. Yasi Rauf Ansari, ASC for the State, submits that during pendency of the present proceedings, the Petitioner has been implicated in two additional cases in 2024–2025 and his history sheet is due for review. Mr. Abhishek Kumar, counsel for the Petitioner submits that out of the four cases listed in the Status Report, one has already been settled.

7. In view of the above, the present writ petition is disposed of with a direction to the State to review the Petitioner’s record and update his criminal record, in accordance with law.

8. The Petitioner shall be at liberty to supply, within one week from today, a copy of this order along with supporting documents to the competent authority, indicating the cases which have been settled. Upon receipt thereof, a fresh order be passed by the concerned authority and the decision be communicated to the Petitioner. In case the Petitioner is aggrieved by this order, he shall be entitled to take recourse to appropriate remedies, in accordance with law.
