1. The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter “BNSS”) [earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter “CrPC”)] has been filed by the petitioner praying for quashing of FIR No. 396/2020, registered at Police Station Roop Nagar, for the offences punishable under Sections 279/337/338/304A of the Indian Penal Code, 1860 (hereinafter “IPC”) and Sections 3/181, 146/196 & 185 of the Motor Vehicles Act, 1988.

2. The brief facts of the case are that on 18.12.2020 at about 11:30 PM near Birla Mill, Ghanta Ghar, Delhi, respondent no. 2, along with his wife Rajkumari and their son, respondent no. 3, was returning on his motorcycle when the said motorcycle was hit at high speed
