1. By way of the present petition, the petitioner is seeking quashing of the FIR bearing No. 0573/2022, registered at Police Station Kirti Nagar, Delhi, for the commission of offences punishable under Sections 288/338 of the Indian Penal Code, 1860 (hereafter ‘IPC') and all consequential proceedings emanating therefrom on the basis of settlement arrived at between the parties.

2. Issue notice. The learned APP accepts notice on behalf of the State.

3. The petitioner and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO)

concerned, Police Station, Kirti Nagar, Delhi.

4. Brief facts of the case are that on 26.12.2022, an accident had occurred at a construction site owned/managed by the petitioner, wherein the respondent no. 2 had sustained injuries. Thereafter, upon the complaint by respondent no. 2, the present FIR came to be registered against the petitioner. It is stated that with intervention of the respected members of the society and the family, the parties have now amicably settled their dispute vide Memorandum of Understanding (MoU) dated 06.09.2025.

On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated that he has already received the compensation amount i.e., salary of three months. Therefore, he has no objection if the present FIR is quashed.

6. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No. 0573/2022, registered at Police Station Kirti Nagar, Delhi, for the commission of offences punishable under Sections 288/338 of IPC and all consequential proceedings emanating therefrom are quashed, subject to the petitioner depositing cost of Rs.25,000/- with ‘Delhi District & Sessions Courts Employees Welfare Association Regd. S/2041/18’, within a period of two weeks from date and the compliance report of the same be filed with the Registry of this Court.

8. In view of above, the present petition stands disposed of.
