O R D E R
% 01.12.2025 CM APPL.75211/2025 (seeking temporary suspension of LOC and permission to travel abroad)
1. The present application has been filed by the applicant/petitioner seeking temporary suspension of the Look Out Circular/s (LOCs) opened against the petitioner by the respondent no.1 and 2 at the instance of respondent nos. 3-19, and permission to travel abroad as and when required, till 16.04.2026, in view of the petitioner’s deteriorating medical condition.
2. It is submitted that the petitioner is suffering from severe medical ailments affecting his lungs, liver, kidney and heart function and therefore the petitioner has availed medical treatment from doctors in USA and UK.
3. It is pointed out that this Court, vide order dated 28.11.2024, had suspended the said LOCs till 05.02.2025 and permitted the petitioner to travel abroad. Subsequently, vide order dated 18.03.2025, this Court suspended the LOCs till 22.07.2025 and permitted the petitioner to travel abroad. However, the petitioner could not avail of the said permission due to delay in renewal of his passport by the passport authority. The renewed passport was issued only after two months, and during the said period, the petitioner’s health condition worsened, necessitating daily dialysis at Delhi.
4. It is further submitted that the petitioner has travelled abroad on multiple occasions for his medical treatment as well as for the medical treatment of his daughter, who is suffering from cancer. It is also submitted that the petitioner has scrupulously adhered to the conditions that were set out by this Court in its previous orders whereby he was permitted to travel abroad.
5. Learned senior counsel for the petitioner submits that the concerned Trial courts (where cases are pending), have granted permission to the petitioner for travelling abroad.
6. In the circumstances, the petitioner seeks extension of the suspension of the LOC issued against him, for the purpose of travelling abroad in connection with his medical treatment.
7. Learned counsel for the respondent/s submit that in case the suspension of the LOC is to be continued, the petitioner be subjected to the same conditions, as imposed by this Court on previous occasions.
8. In the circumstances, the present application is allowed. It is directed that the LOC/s issued qua the petitioner shall stand suspended till 16.04.2026 and the petitioner shall be permitted to travel abroad subject to the following conditions:-
(a) The FDR deposited by the petitioner in terms of order dated 28.11.2024 shall continue to remain deposited with the Registrar General of this Court. The aforesaid FDR shall be continued to be kept on auto-renewal mode. For this purpose, the Petitioner shall produce the concerned officer of the Bank whose FDR is being deposited for recording of his statement. The petitioner shall furnish an affidavit of undertaking to the Registrar General that the petitioner shall not encash / withdraw the said FDR till the pending LOC/s issued against him is suspended.
(b) An affidavit of undertaking shall be furnished to the Registrar General of this Court that the petitioner shall return to India by
16.04.2026.
