1. Matter has been taken up today as 25.11.2025 was declared a holiday on account of 350th Anniversary of ‘Guru Teg Bahadur’s Martyrdom Day’.

2. The present appeal has been filed under Section 378(4) Cr.P.C. by the appellant/complainant against the judgement dated 24.12.2021 passed by learned JMFC, NI Act, THC Courts in the case bearing CC No. 6199/16 titled as ‘M/S A.N. TRADERS PVT. LTD. v. SAJAN THOMAS’ vide which the respondent was acquitted of the offense under Section 138 NI Act. The appellant had approached this Court vide CRL.L.P. No. 220/2022 seeking leave to appeal and the same was granted by this Court vide order dated 25.01.2023, following which the appeals were duly admitted.

3. The appellant is the complainant under Section 138 of the NI Act who is aggrieved by the dishonour of the cheques statedly issued by the respondent. The trial which was initiated on the basis of his complaint has culminat
