1. On 13.08.2025, the parties were referred to the mediation process. The Delhi High Court Mediation and Conciliation Centre has filed a settlement agreement dated 10.10.2025 whereby the parties have settled their dispute pursuant to the judgment/decree dated 28.07.2023 of the District Judge, Commercial Court in CS (Comm.) 30/2023, which is the subject matter of this appeal. In paragraphs 4 & 5 of the settlement agreement, the following has been stated:-
“4. That the Appellants/First Party herein agrees and gives his no objection that out of the deposited amount i.e. Rs. 4,62,000/- (Rupees Four Lacs Sixty Two Thousand Only) before the Ld. Registrar General of the Hon'ble High Court of Delhi, the mutually agreed amount i.e. Rs. 3,87,500/- (Rupees Three Lacs Eighty Seven Thousand Five Hundred Only) along with registration certificate of vehicle number HR98H4512 Submitted before Ld. Registrar General of the Hon'ble High Court of Delhi, be released to the Respondent/Second Party and the Respondent/Second Party further agrees and gives his no objection that the remaining amount out of the deposited amount i.e. Rs. 74,500/- (Rupees Seventy Four Thousand Five Hundred Only) alongwith interest if any accrued upon the same be released to the Appellants/First Party in terms of the settlement arrived at between the parties.
5. That the parties agrees to move appropriate application seeking release of the amount deposited by the First Party before Delhi High Court within 30 days from the date of signing of the present settlement agreement alongwith their respective affidavits of undertaking to comply the present settlement agreement and abide by with the terms and conditions of the present settlement agreement before the Hon'ble High Court of Delhi in RFA(Comm.) 300/2023 titled as 'Rahul Jain & Ors. Versus M/s. SR India Voyages Pvt. Ltd. That both parties agrees to cooperate with each other by presenting themselves or by signing requisite application/documents for the release of the amount as agreed herein.”

If that be so, the Registry shall release the amount of Rs. 3,87,500/- (Rupees Three Lakhs Eighty Seven Thousand and Five Hundred Only) from the amount deposited before the Registrar General of this Court in favour of the respondent/company through its representative, in the presence of counsel for the respondent. The balance amount along with accrued interest shall be released to the appellants in the presence of their counsel.
3. We take on record the settlement agreement dated 10.10.2025 and the submission of the learned counsel that the same shall bind the parties.
4. We also take on record the submission of the learned counsel for the parties that the impugned judgment/decree dated 28.07.2023 shall stand satisfied in terms of the settlement agreement dated 10.10.2025.
5. At this stage, the learned counsel for the appellants makes a request for the refund of the Court fees. The Registry shall issue a certificate for refund of 50% of the court fee as deposited along with the appeal.
6. The appeal along with pending applications is disposed of, as settled.
