1. The present writ petition has been filed inter-alia seeking extension of the license period granted in respect of MPS Stall No. KYN-MPS-2 at Kalyan Railway Station Near Main Booking Office (West).

2. In the present case, the Railway Administration allotted the aforesaid license to the petitioner on 3^rd May, 2021. On 15^th June, 2021, a Master Licence Agreement was entered into with the petitioner.

3. As per the aforesaid agreement, the license was for a period starting from 15^th June, 2021 to 14^th June, 2026.

4. It is stated that the petitioner could not operate the stall during the COVID period and hence, he seeks extension of the term of the license in line with orders passed by this Court in other writ petitions. The petitioner claims parity with similar extension granted by this Court in other writ

5. I have heard the counsel for the parties.

6. Attention of this Court has been drawn to the order passed by this Court on 24^th February 2025 in W.P.(C) 2243/2025, titled as “Deepak Narain v. Union of India & Ors.”, wherein a further extension of seven (7) months has been granted to the petitioner therein. The attention of this Court has also been drawn to various other orders passed by this Court which have been filed with the petition.

Thus, considering the fact that similar orders have been passed on previous occasions by this Court, this Court is of the view that in parity with the orders passed earlier by this Court, a similar order ought to be passed in the present case also. This Court sees no reason to take a different view from the orders passed earlier.

8. Accordingly, it is directed that, subject to the payment of the license fees, the petitioner will be allowed to operate the MPS Stall No. KYN-MPS-2 at Kalyan Railway Station Near Main Booking Office (West), for a period of

7 months from 15^th June, 2026, at the stipulated license fees.

9. The petitioner is directed to file an undertaking, on an affidavit, before this Court, within a period of four (4) weeks from today, that the petitioner shall vacate the stalls in question, on expiry of the extended period of 7 months, failing which, the respondents will be at liberty to remove the goods of the petitioner, from the stall in question.

10. It is further made clear that extension of the license fees of the petitioner will not preclude the Railways from inviting fresh tenders, for the awarding of the license on expiry of the extended period of license of the
