1. By way of the instant petition, the petitioners seek quashing of FIR bearing no. 87/2020, registered at Police Station Fatehpur Beri, Delhi for the commission of offence punishable under Sections 323/341/452/308/

506/509/34 of the Indian Penal Code, 1860 (hereafter ‘ IPC ’).

2. The petitioners and respondent no. 2 are present before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Fatehpur Beri, Delhi.

3. Briefly stated, the facts of the present case are that petitioner and respondent no. 2 are neighbours residing in the same locality and are known to each other. It is stated that due to some misunderstanding, a quarrel had taken place between the parties, in which both the parties had sustained injuries. Subsequently, based on a complaint filed by respondent no. 2, the present FIR was registered against the petitioners for offence punishable under Sections 323/341/452/308/506/509/34 of IPC. After investigation, the chargesheet was filed before the concerned Court. It is stated that a cross- FIR bearing No. 196/2020 was also registered against the respondent no.2 and his family members for commission of offence punishable under Section 323/308/34 of IPC. It is further stated that with the intervention of respectable persons of the society and relatives of the parties, both the parties have settled all their disputes vide Memorandum of Understanding dated 05.03.2024.

4. The learned APP for the State submits that the petitioners herein have no previous involvement in any other case.

5. On a query made by this Court, respondent no. 2 who has been identified by the concerned IO, have categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat and he has no objection, if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing no. 87/2020, registered at Police Station Fatehpur Beri, Delhi for the commission of offence punishable under Sections 323/341/308/452/506/509/34 of IPC and all consequential proceedings emanating therefrom are quashed, subject to the petitioners depositing cost of Rs.1,000/- each in the form of donating educational books to the library of a Government school situated in the vicinity of their residence, after ascertaining from the Principal/Head of the concerned school or institution the nature and requirement of books needed for the school library, so as to ensure that the books donated are relevant and beneficial to the students. The said exercise shall be completed within a period of two weeks from date and the compliance of the same shall be filed with the Registrar General of this Court.

8. In view of the above, the present petition alongwith pending application, if any, stands disposed of.
