1. Respective counsel for the parties submit that a settlement agreement has been entered into between the parties. The same, inter alia, provides for a payment of a sum of Rs.1.2 crores by Mr. Vivek Kumar Singh to the petitioner. The settlement agreement records as under:-

“2. Payment Schedule

2.1 The SECOND PARTY shall pay to the FIRST PARTY THE Settled Amount of Rs.1,20,00,000/- (Rupees One Crore Twenty Lakhs Only) in the following manner:

i. Rs.60,00,000/- (Rupees Sixty Lakhs only) immediately upon execution of this settlement Agreement by way of a Demand Draft bearing No.720964 (copy enclosed) dated 29.01.2026 drawn on Union Bank of India, issued through M/s Alert Industries Pvt. Ltd. of whom Mr. Vivek Kumar Singh is the Director having DIN No. 01564596.

ii. Rs.10,00,000/- (Rupees Ten Lakhs only) by way of a Post-Dated Cheque (PDC) bearing No 244849 (copy enclosed) dated 25.02.2026 drawn on State Bank of India issued by Mr. Vivek Kumar Singh, Cheque (PDC) bearing No 907035(copy enclosed) dated 25.02.2026 drawn on State Bank of India issued by Mr. Vivek Kumar Singh, Cheque (PDC) bearing No 244848 (copy enclosed) dated 25.03.2026 drawn on State Bank of India issued by Mr. Vivek Kumar Singh, v. Rs.10,00,000/- (Rupees Ten Lakhs only) by way of a Post-Dated Cheque (PDC) bearing No 907033 (copy enclosed) dated 25.03.2026 drawn on State Bank of India issued by Mr. Vivek Kumar Singh, vi. Rs.10,00,000/- (Rupees Ten Lakhs only) by way of a Post-Dated Cheque (PDC) bearing No 244850 (copy enclosed) dated 25.04.2026 drawn on State Bank of India issued by Mr. Vivek Kumar Singh, vii. Rs.10,00,000/- (Rupees Ten Lakhs only) by way of a Post-Dated Cheque (PDC) bearing No 907034 (copy enclosed) dated 25.04.2026 drawn on State Bank of India issued by Mr. Vivek Kumar Singh, Mr. Vivek Kumar Singh has personally assured/undertake that all the above six PDC's upon presentation, shall be dully honored and payment of the same shall not be stopped on any count and Mr. Vivek Kumar Singh shall be personally responsible/liable for making the payment; and in the event of any PDC's being returned unpaid the same shall amount to breach of the terms and conditions of Settlement Agreement and shall be liable to pay the full amount as awarded.”

2. Mr. Vivek Kumar Singh, who appears virtually, submits that each and every post dated cheques referred to in the aforesaid clause shall be honoured without fail.

3. It is agreed that in the event of a single post dated cheque getting bounced for whatsoever reason, the same shall be construed as wilful and egregious disregard on the part of Mr. Vivek Kumar Singh, of the undertaking given to this Court, entailing severe action under the Contempt of Courts Act, 1971.

4. It is further assured by Mr. Vivek Kumar Singh that in terms of the settlement agreement, possession of the property in question shall be handed over to the petitioner on or before 28.02.2026.

5. In the above background, at joint request of the parties, re-notify on

02.03.2026 in the category of “Supplementary Matters”.

6. The parties also agree that they shall take adjournment in the execution proceedings.

7. In view of the aforesaid circumstances, Non-bailable Warrants issued on 09.01.2026 against Mr. Vivek Kumar Singh are recalled.
