1. Allowed, subject to all just exceptions.
2. The application stands disposed of.
CM APPL.7054/2026 (on behalf of the petitioner for ad-interim reliefs)
3. The present application has been filed by the applicant/petitioner seeking the following prayers:-
“a) Pass an ad-interim ex-parte order staying the operation and effect of the Impugned Award dated 14.12.2023 passed by the Industrial Tribunal- I, Rouse Avenue District Courts, New Delhi, in POIT No. 13/2023 till them final adjudication of the present writ petition; and b) Pass an ad-interim ex-parte order staying the Notice dated dated 16.01.2026 under Section 33 C(1) of the Industrial Disputes Act, 1947 issued by the Office of Joint Labour Commissioner, South East District, Labour Department, Government of NCT of Delhi till the final adjudication of the present writ petition; and c) Pass an ad-interim ex-parte order staying further proceedings in relation to the Impugned Award dated 14.12.2023 before Office of Joint Labour Commissioner, South East District, Labour Department, Government of NCT of Delhi till the final adjudication of the present writ petition; and d. Pass any other order(s) as deemed fit in the facts and circumstances of the case.”

Learned counsel on behalf of the petitioner points out that pursuant to passing of the impugned award dated 14.12.2023 by the Industrial Tribunal- I, Rouse Avenue District Courts, New Delhi in POIT No.13/2023, a show cause notice dated 16.01.2026 has been issued by the Office of Joint Labour Commissioner, South-East District, Labour Department, Government of NCT of Delhi, directing the petitioner to pay a sum of Rs.63,86,653/-. The said show cause notice has been filed as Annexure A-2 with the present application.
5. It is submitted that the Show Cause Notice dated 16.01.2026 has inflated the amount quantified in the Impugned Award dated 14.12.2023. It is submitted that if the same is executed, irreparable injury would be caused to the petitioner.
6. In the above background, the present application has been filed.
7. Issue notice.
8. Learned counsel, as aforesaid, accepts notice on behalf of the respondent(s) / non-applicant(s).
9. Considering the averments made in the application, it is directed that subject to the petitioner depositing an amount of Rs.50,00,000/- with the Registry of this Court, within a period of eight weeks from today, the operation and effect of the impugned award dated 14.12.2023 shall remain stayed till the next date of hearing.
10. Further, subject to the aforesaid deposit, no further action shall be taken pursuant to the afore-mentioned notice dated 16.01.2026 issued by the Office of Joint Labour Commissioner, South-East District, Labour Department, Government of NCT of Delhi.
11. The said amount shall be kept in an interest-bearing FDR and shall be subject to further orders in the present petition.
12. The application stands disposed of in the above terms.
