O R D E R

% 03.02.2026 CRL.M.A. 3584/2026 By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the applicant/petitioner No.1 seeks temporary suspension of the Look-Out-Circular (‘LOC’) pending against her; and for permission to travel to Germany and Italy for a period of 02 weeks from 08.02.2026 to 22.02.2026.

Mr. Ashish Batra, learned counsel appearing for the petitioners submits, that vidé order dated 16.01.2026 passed in CRL.M.A. No.321/2026, similar relief was granted to the petitioner for travelling to Dubai for the Gulfood Festival from 20.01.2026 to 10.02.2026.Counsel submits however, that in the meantime, the petitioner has received a nomination to participate as a delegate/team member in Biofach 2026, as seen from the documents relating to the Agricultural and Processed Food Products Export Development Authority and the Indian Rice Exporters Federation, copies of which have been appended to the application.

3. It is submitted that by reason thereof, petitioner No.1 has returned to India on 31.01.2026, earlier than was planned; and now seeks temporary suspension of the LOC pending against herand for permission to travel to Germany and Italy for a period of 02 weeks from 08.02.2026 to 22.02.2026.

4. Counsel submits, that petitioner No.1 has never violated any condition imposed upon her as part of the permission to travel; and undertakes to be bound by any directions that the court may issue.

5. Issue notice.

6. Mr. Amit Tiwari, learned CGSC appears on behalf of Union of India on advance copy; accepts notice; and submits that in view of the relief granted to petitioner No. 1 earlier; and subject to the same conditions, the prayers made in the present application may be considered by this court.

7. In view of what has been narrated in the application; and the stand taken by learned CGSC, the present application is allowed.

8. Accordingly, petitioner No.1 is permitted to travel on business to Germany and Italy for the Biofach 2026 from 08.02.2026 to 22.02.2026, subject to the same conditions as were imposed by the learned Predecessor Bench vidé order dated 21.04.2025, which are as follows:

8.1. Petitioner No. 1 shall furnish before the learned Joint-Registrar a Fixed Deposit Receipt (FDR) in the sum of Rs.5 lacs (Rs. Five Lacs Only) as security for her timely return to the country and for joining the ongoing investigation in the case;

8.2. In addition to the above, petitioner No. 1 shall also furnish before the learned Joint-Registrar a personal bond in the sum of Rs. 5 lacs (Rs. Five Lacs Only) also as security for her timely return to the country and for joining the ongoing investigation in the case;

8.3. Petitioner No.1 shall not visit any destination other than Germany and Italy for the Biofach 2026 from 08.02.2026 to

22.02.2026;

8.4. If her presence is required by the I.O. in connection with investigation during her travel period, petitioner No. 1 shall return to India and join investigation within 48 hours of receiving information in this regard from the I.O. through WhatsApp/e-mail or any other mode of communication;

8.5. Petitioner No. 1 shall inform this court about her arrival back in India within 48 hours of her return; and shall also file copies of the relevant pages of her passport showing her return to the country; and written intimation in that regard shall also be given by her to the I.O.;

8.6. Petitioner No. 1 shall not, under any circumstances, request for extension of the duration of her stay abroad;

8.7. During the above-said period, petitioner No. 1 shall not undertake any transaction of sale, lease,
