1. This hearing has been done through hybrid mode.

2. The present petition under Section 24 read with Section 151 of the CPC seeks the following prayers: -

“It is, therefore, most respectfully prayed. that this Hon'ble Court may kindly be pleased to allow the present application and pass necessary orders for transfer of the Civil suit i.e. CS no. 413/2024 titled as "Sandeep Kumar Gupta Vs. Shashi Shrama", pending in the court of Sh.Gaurav, Ld.District Judge-01, Distt. Shahdara, Karkardooma Courts, Delhi to the concerned court of North East District, Karkardooma Courts, Delhi in view of the territorial jurisdiction on the basis of suit property so that the case may be heard and decided as per law, in the interest of justice.

Pass any other order or relief which this Hon'ble Court under the facts and circumstances of the case may deem fit and proper in favour of the applicant/Petitioner and against the Respondent.”

Learned counsel for the petitioner-plaintiff has submitted that initially the suit, CS No. 413/2024, seeking possession, permanent and mandatory injunction, recovery of damages/mesne profit was filed on behalf of the latter before the Court of learned District Judge, Shahdara District, Karkardooma Courts; however, subsequently, it came to the knowledge of the petitioner- plaintiff that the suit property which is situated in area of village Khureji Khas, Delhi, which falls within the territorial jurisdiction of North-East District.

4. Attention of this Court has been drawn to an order dated 11.12.2024 passed by learned District Judge in the aforesaid suit wherein, the aforesaid fact was recorded, and in view of the same, learned counsel for the petitioner had sought time to clarify on the aspect of territorial jurisdiction.

5. In pursuance of the notice issued to the respondent vide order dated 26.08.2025, learned counsel for the respondent enters appearance and submits that he has no objection, if the present petition is allowed, and the aforesaid suit is transferred to the Court of Competent jurisdiction in the North-East District.

6. In view of the above, the present petition is allowed. Civil suit, i.e., CS No. 413/2024 titled as "Sandeep Kumar Gupta v. Shashi Sharma", pending before the Court of learned District Judge-01, District Shahdara, Karkardooma Courts, Delhi, is transferred to the Principal District Judge, North-East District, Karkardooma Courts, Delhi, who shall assign the same to the Court of competent jurisdiction. Let the records of the said suit be transferred to the concerned Court within a period of 10 days. Parties are directed to appear before the concerned Court accordingly.

7. With the aforesaid direction, the present petition is disposed of.

8. It is clarified that the learned Transferee Court will proceed with the suit from the stage at which it is being transferred.

9. Pending applications, if any, also stand disposed of accordingly.

10. Copy of the order be sent to the learned Principal District Judge, North– East District, Karkardooma Courts, Delhi, for necessary information and compliance.

11. Order be uploaded on the website of this Court, forthwith.
