O R D E R

% 05.02.2026 I.A. 3174/2026 (u/O 23 Rule 3 read with Section 151 CPC)

1. This joint application is filed on behalf of the parties under Order XXIII Rule 3 CPC for recording of settlement arrived at between them.

2. During the pendency of the suit, Suit Patent IN’051 expired on 16.01.2023. Thereafter, parties settled their inter se disputes amicably and the terms of settlement are incorporated in paragraph 3 of the application, which are extracted hereunder for ready reference:-

“3. On account of suit patent IN’051 having expired, the parties hereby agree as follows:

a. The Plaintiffs hereby undertake to forego their claims of injunction, damages, rendition for accounts of profits, delivery up, etc. and any other claims made in prayer paragraph no. 39(a) to (f) of the Plaint;

b. The Defendant hereby undertakes to forego its claims made in prayer paragraph no. 79 i) to v) of the written statement and agrees not to press any claim, demand, allegation arising in connection with the present suit;

c. No Party shall be entitled to any claim or damages in connection with the present proceedings;

d. In view of the aforesaid, all claims pertaining to the present suit bearing no. CS(COMM) 557/2020, arising out of the manufacture, import, marketing, use, sale, supply or other exploitation of Valsartan and Sacubitril products (subject matter of the suit patent IN’051) by the Defendant, stands fully and finally settled between the Parties.”

3. Court has perused the terms of the settlement and finds the same to be lawful.

4. Accordingly, the application is allowed, recording the settlement between the parties.

5. Application stands disposed of.

CS(COMM) 557/2020 & I.A. 5231/2021, 6238/2022

6. This suit is filed on behalf of the Plaintiffs seeking decree of permanent injunction restraining Defendant and all other acting on its behalf from infringing Plaintiff No. 1’s Indian Patent No. 229051. Reliefs of damages, rendition of accounts, delivery-up etc. are also sought.

7. In view of the order passed in I.A. 3174/2026 above, suit is decreed in terms of the settlement stated in paragraph 3(a) to (d) of the above application, which shall form a part of the decree and needless to state shall bind the parties.

8. Registry is directed to draw up the decree sheet.

9. Learned counsel for the Defendant points out that vide order dated 25.03.2022, Court had directed the Defendant to deposit a sum of Rs. 5 crores with the Registrar General of this Court and the same be released.

10. In light of the amicable settlement between the parties, Registry is directed to release the deposited amount of Rs. 5 crores to the Defendant, for which purpose, matter be listed before learned Joint Registrar on 02.03.2026, who shall release the said amount in favour of the Defendant on verification and completion of other formalities.

11. Suit stands disposed of along with pending applications.

12. Date of 23.03.2026 stands cancelled.
