O R D E R

% 05.02.2026 CRL.M.(BAIL) 756/2025

1. This application under Section 430 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (the BNSS) read with Section 389 and Section 482 of the Code of Criminal Procedure, 1973 (the Cr.P.C.) has been filed seeking suspension of sentence of the accused in CBI Case No. 47/2020 on the file of the learned Principal District & Sessions Judge-cum-Special Judge (PC Act), CBI, Rouse Avenue District Courts, Delhi. The appellant/accused has been convicted of the offence punishable under Section 7 of the Prevention of Corruption Act, 1988 (the PC Act) vide judgment and order on sentence dated 21.03.2025 and has been sentenced to undergo rigorous imprisonment for a period of three years along with a fine of ₹20,000/-, and in default of payment of fine, to rigorous imprisonment for a period of two months. The benefit of Section 428 Cr.P.C. has been granted to the appellant/accused.

2. As per the order dated 17.04.2025, interim suspension of sentence has already been granted, which has been extended from time to time.

3. Since the sentence is only for three years, the sentence of the appellant is suspended during the pendency of the appeal on executing a personal bond of ₹25,000/- with two solvent sureties for the like amount each to the satisfaction of the trial court, subject to the following conditions:-

(i) The appellant shall provide his mobile number to the Station House Officer (SHO) concerned, on which he shall remain available during the pendency of the present appeal. In case of change in the number, he shall inform the SHO forthwith.

(ii) In case of change of residential address or contact details, the appellant shall promptly inform the SHO concerned as well as to this Court.

(iii) The appellant shall appear before the Court as and when directed.

(iv) The appellant shall not leave the country without the prior permission of this Court. If he owns a passport, he shall surrender the same before the trial court. If he does not have a passport, he shall file an affidavit to the said effect.

(v) The appellant will not commit any offence(s)

while on bail.

(vi) Needless to say, in the event of violation of any of the aforementioned condition(s), the suspension of sentence granted shall forthwith stand cancelled.

4. With the above directions, the application is disposed of.

5. A copy of this order be communicated electronically to the Jail Superintendent concerned for information and compliance.
