O R D E R

% 05.02.2026 I.A. 2934/2026

1. The present application has been filed on behalf of respondent no. 2 seeking condonation of delay of 24 days in filing the objections/reply to the present probate petition.

2. Learned counsel appearing for the petitioners submits that he has no objection if the delay of 24 days is condoned.

3. Accordingly, with the consent of the parties, the delay of 24 days in record.

5. With the aforesaid directions, the present application is disposed of.

TEST.CAS. 94/2025

6. In view of the fact that the reply/objections filed on behalf of respondent no. 2 has been taken on record by today’s order, learned counsel appearing for the petitioners is granted liberty to file rejoinder thereto, within a period of six weeks, from today.

7. At this stage, learned counsel appearing for the petitioners also presses their application for interim relief being I.A. 26364/2025.

8. Learned counsel appearing for respondent no. 2 submits that, for the time being, there is no proposal for creating any third-party rights with respect to the properties, which are subject matter of the present petition.

9. The aforesaid statement is taken note of.

10. Accordingly, it is directed that, in case, there is any proposal by respondent no. 2 regarding creation of any third-party right in the properties being the subject matter of the present petition, prior permission shall be taken from the Court.

11. Thus, respondent no. 2 is held bound to approach this Court, in case there is any proposal for creation of any third-party right in the subject properties and further, no third-party right shall be created without the permission of this Court.

12. Noting the aforesaid, I.A. 26364/2025 is disposed of.

13. At this stage, learned counsel appearing for the petitioners submits that respondent no. 3 has expired on 02nd February, 2026, and that he shall take necessary steps to bring on record the legal heirs of deceased respondent no. 3.

14. Accordingly, list for further proceedings before the Joint Registrar (Judicial) on 25th March, 2026.
