O R D E R

% 06.02.2026 CRL.M.(BAIL) 1781/2025

1. This application under Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the accused no. 1 in Sessions Court No. 126/2019 on the file of Additional Sessions Judge (FTC)-03, South East District, Saket Courts, New Delhi, seeking suspension of sentence during the pendency of the appeal. The appellant has been found guilty of the offences punishable under Sections 394 and 34 of the Indian Penal Code, 1860 (the IPC). Vide order dated 02.07.2025, the appellant has been sentenced to rigorous imprisonment for a period of three years along with fine of ₹1,000/- for the offence punishable under Sections 394 and 34 IPC and in default of payment of fine, rigorous imprisonment for one month. The benefit under Section 428 of the Code of Criminal Procedure, 1860 has been extended to the appellant.

2. It is brought to my notice that the sentence of the appellant was suspended by this Court vide order dated 25.08.2025 on the same terms and conditions as that has been imposed by the trial court.

3. Hence, the sentence of the appellant shall stand suspended until further orders on execution of a personal bond of ₹15,000/- with two solvent sureties for the like amount each to the satisfaction of the trial court, subject to the following conditions:-

(i) The appellant shall provide his mobile number to the Station House Officer concerned, on which he shall remain available during the pendency of the present appeal. In case of change in the number, he shall inform the SHO forthwith.

(ii) In case of change of residential address or contact detail, the appellant shall promptly inform the SHO concerned as well as to this Court.

(iii) The appellant shall appear before this Court as and when directed.

(iv) The appellant shall not leave the country without the prior permission of this Court.

(v) The appellant will not commit any offence(s)

while on bail.

(vi) Needless to say, in the event of violation of any of the aforementioned condition(s), the suspension of sentence granted shall forthwith stand cancelled.
