1. This petition has been filed with the following prayers:-

“a) Issue a writ ·of Certiorari or any other writ/order and/or direction/ directions of like nature, thereby, quashing the order of cancellation of the technical bid offered by the petitioner issued by the respondent authorities in Tender no. GEM/2025/B/6222099 dated 12-05-2025, being rejected in utmost arbitrary and illegal manner in blatant contravention of terms and conditions of the Tender and in blatant contravention of the Government of India regulations pertaining to the MIT (Make in India) purchase preference regulations.

b) Issue a writ of Certiorari or any other appropriate writ, order or direction quashing and setting aside the Tender dated 12~05.2025, being proceeded with by the Respondent Authorities in an arbitrary, illegal and discriminatory manner, in gross violation of the terms and conditions of the tender document itself;

c) Issue a writ of Mandamus or any other appropriate writ, order or direction directing the Respondent Authorities to act strictly in accordance with the terms and conditions of the tender document, and in compliance with Articles 14 and 19(1 )(g) ofthe Constitution of India;

d) Issue an appropriate writ, order or direction restraining the Respondent Authorities from taking any further steps pursuant to the impugned Tender dated 12.05.2025, including finalization or award thereof, during the pendency of the present writ petition;

e) Issue a writ of Mandamus or any other writ/order and/or direction/directions of like nature, thereby, directing the respondent authorities for accepting the technical bid of the petitioner company after satisfying itself with the terms and conditions as delineated in the tender I bid documents (i.e. GEM/2025/B/6222099 dated 12'-05-2025) and as per the Govt. Of India regulatory guidelines and to follow the Make In India Guidelines as specified in the Tender itself in Letter and Spirit.

f) Pass any other or further order(s) as this Hon'ble Court may deem fit and. proper in the facts and circumstances of the present case, in the interest of justice.

g) Direct the Respondents to pay the cost of litigation cost to thepetitioner.”

2. When the matter was taken for hearing in the morning session on the request of the learned counsel for the respondents, we had passed over the matter, to be taken up at 02:30PM i.e., post lunch.

3. Mr. Puneet Taneja, learned Senior Counsel for the respondents on instructions states that, reverse auction has taken place and the successful party has been identified. He states further negotiations are being held.

4. Suffice to state that we shall take this petition for hearing on

11.02.2026.
