3. The is an application filed by the Appellant seeking suspension of his sentence and release during the pendency of the appeal before the Court.

4. The instant appeal has been filed by the Appellant challenging the impugned judgment dated 3^rd December, 2025, along with the order on sentence dated 8^th December, 2025 wherein the Appellant has been convicted under Section 376(2)(h)(i)/376D/506 IPC and Section 6 of the Protection of Children from Sexual Offences (POCSO) Act, 2012. Vide the order on sentence, the Appellant has, inter alia, been sentenced to imprisonment for remainder of his life.

6. Issue notice to the Respondent in CRL.M.(BAIL) 309/2026. Mr.

Ashneet Singh, ld. APP for the State accepts notice.

7. Let a reply/status report be filed by the State before the next date of hearing.

8. Let notice be issued to the survivor in this case as well through the concerned SHO.

9. The Registry is directed to requisition the TCR and prepare the appeal paperbook with proper indexing, pagination and bookmarks expeditiously. Let the TCR be tagged along with this appeal by the next date of hearing.

10. Let the ld. Counsels for the parties obtain the copy of the TCR, as also the paperbook, and make their submissions on the next date of hearing.

11. The physical TCR be also requisitioned to the Court on the next date of hearing by the Registry.

12. The latest nominal roll of the Appellant be requisitioned from the concerned Jail Superintendent by the next date of hearing.

13. Accordingly,letacopyofthisorderbycommunicatedtotheconcerned Jail Superintendent by the Registry for necessary information and compliance.

14. Let the affidavit of past antecedents of the Appellant be also filed and a copy thereof be served upon the ld. APP for State for verification of the same.

15. Itisfurthernotedthatintheimpugnedorderonsentence,compensation has also been directed to be paid to the survivor.

16. Accordingly, notice is issued to the Secretary, District Legal Services Authority (DLSA), Shahdara, to also file a status report as to the payment of compensation to the survivor.

17. In a large number of matters, it is noticed that the compensation that is being awarded by the concerned Trial Courts is not being granted to the victims in rape cases, POCSO cases, as also in other criminal cases, such as murder, culpable homicide, etc.

18. During the course of proceedings in several cases before this Court when the concerned DLSAs have appeared, the consistent response in this regard has been that though the orders on sentence are passed by the Trial Court, where the compensation is awarded to the Victims, such orders are not communicated to the concerned DLSA.

19. This Court had, in CRL.A. 475/2020 titled Rampreet v. State, taken cognizance of the issue pertaining to the gap in communication between the Trial Courts and various DLSAs, which leads to delay in disbursement of compensation to the victims. In the said matter, vide its order dated 18th December, 2024, the Court had observed as under:

In the present case, the Court vide order dated 24th September, 2024 observed that there is a disconnect between Protection of Children from Sexual Offences (‘POCSO’) Courts and the concerned Delhi State Legal Service Authorities with regard to the manner in which victim compensation is being disbursed to survivors.
