O R D E R

1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:

“a) Issue a Writ of Mandamus or any other appropriate Writ, Order or Direction, directing the Respondent No. 1 (Medical Counselling Committee) and Respondent No. 2 (Vardhman Mahavir Medical College) to permit the Petitioner to retain the already allotted seat of MD(Pathology) at Vardhman Mahavir Medical College, New Delhi during Round 2 of the Counselling Process and;

b) To permit the Petitioner to participate in Round 3 of the NEET PG counselling process for the academic year 2025 while reserving the seat of MD(Pathology) at Vardhman Mahavir Medical College, New Delhi, already allotted and joined by the Petitioner in Round 2, with the option to decline any upgraded seat in Round 3 and retain the Round 2 seat.

c) In the alternative, issue a Writ of Mandamus or any other appropriate Writ, Order or Direction, directing the Respondent No. 1 (Medical Counselling Committee) and Respondent No. 2 (Vardhman Mahavir Medical College) to permit the Petitioner to participate in the Stray Vacancy Round of the NEET PG counselling process for the academic year 2025 without forfeiting their Round 2 seat of MD(Pathology) at Vardhman Mahavir Medical College, New Delhi, should they not secure a desired upgrade in Round 3.

d) Issue a Writ of Mandamus or any other appropriate Writ, Order or Direction, directing the Respondent No. 1 to explain the discrepancies in the Round 3 NEET PG Medical Counselling 2025 results, specifically the issuance and subsequent removal of a provisional result on 03.02.2026 and the final result on 06.02.2026, and to ensure transparency and consistency in all future counselling processes.”

2. It is stated by Mr. Singh, learned senior counsel for the petitioner that pursuant to the third round of counselling, the petitioner instead of upgradation has been downgraded.

3. He further states that it is implicit that in upgradation the seat obtained in second round will be kept for the petitioner till the petitioner confirms the seat in the third round which has not been so done.

4. For the said reasons, issue notice.

5. Ms. Kaushik, learned counsel accepts notice for all the respondents, seeks and is granted 2 days to obtain instructions.

6. In the meanwhile, the petitioner’s seat of MD (Pathology) will not be allotted.

7. List on 13.02.2026.
