1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following reliefs:
a) “Issue a Writ of Certiorari to quash and set aside the impugned order dated 30.01.2026 passed by the Respondent No. 2, rejecting the request for correction of the Petitioner’s subject from Mathematics (041) to Biology (044) ;
b) Issue a Writ of Mandamus directing the Respondent No.
1 to correct the clerical error in the List of Candidates (LOC) submitted by the Respondent No. 3, by substituting Mathematics (041) with Biology (044) against the Petitioner’s name, and to issue a corrected Admit Card to the Petitioner for the Biology examination and to permit the Petitioner to appear in the Biology examination; and c) Direct the Respondents to permit the Petitioner to appear in the Biology practical examination and to conduct the same at the earliest, in the interest of justice and fair academic evaluation; and…”
2. The petitioner is a student of Class XII studying in Rajindra Public School (“respondent No. 3”) and the respondent No. 3 has wrongly, uploaded the petitioner’s subject to be mathematics instead of biology with the respondent No. 1, i.e. Central Board of Secondary Education (“CBSE”). As a result, the petitioner could not appear in the practical exams.
3. The petitioner makes statement on oath that the petitioner has studied Biology in Class XI and XII. Despite that, the form of the petitioner shows the petitioner to be a student of Mathematics.
4. I am of the view that the mistakes are clerical in nature and the academic carrier of the petitioner cannot be permitted to be prejudiced by such clerical errors.
5. For the said reasons, the subject of the petitioner shall be considered as Biology in place of Mathematics. CBSE shall make necessary modifications accordingly.
6. Additionally, the clerical error on behalf of the school has resulted in wasting valuable time, resources and energy of the petitioner, which should have been utilized for preparing of the exams. The CBSE is at liberty to impose appropriate costs on the school for the said clerical mistake, after hearing the school.
7. The petitioner shall be entitled to give their practical examinations as well and all consequential actions shall follow automatically.
8. The petition is disposed of in aforesaid terms. This order shall not be treated as a precedent.
9. Dasti under the signature of the Court Master.
