The present writ petition has been filed seeking a direction to the respondents no.1, 8 and 9 to take action against the unauthorized construction being carried out by the respondents no.2 to 7 at property bearing House no. 13, Village Jogabai, Batla House, Jamia Nagar, Okhla, New Delhi 110025 admeasuring 510 square yards falling under Khasra no.

161.

3. The petitioner has drawn attention of the Court to the order passed by this Court on 20^th November, 2024 in W.P.(C) 3429/2024 titled Naresh Yadav vs. Municipal Corporation of Delhi & Ors., wherein MCD was directed to take action in accordance with law.

4. The grievance of the petitioner is that despite the aforesaid order having been passed, the respondents no.2 to 7 are still continuing with the unauthorized construction in the aforesaid property.

5. Issue notice.

6. Notice is accepted by counsel appearing on behalf of the respondents

1, 6, 7, 8 and 9.

7. Let notice be issued to the remaining respondents through all permissible modes including email.

8. Counsel appearing on behalf of the respondent/ MCD submits that the demolition action was taken against the subject property. However, despite the same, the respondents no.2 to 7 have proceeded with the construction in the said property.

9. Status reports be filed on behalf of the respondents no.1, 8 and 9 within four (4) weeks.

10. Counsel appearing on behalf of the private respondents no.6 and 7 questions the locus of the petitioner to file the present writ petition.

11. The petitioner shall file an affidavit giving particulars of his ownership of the subject property, along with documents in support, within two (2) weeks from today.

12. Counter-affidavit(s) be filed on behalf of the respondents no.2 to 7 within four (4) weeks.

13. In the meanwhile, no further construction shall be carried out in the subject property by the respondents no.2 to 7.

14. The respondents no.1 and 8 shall ensure that no further construction is carried out in the subject property.

15. List on 13^th May, 2026.
