3. By virtue of the present application, the appellant seeks condonation of delay of 15 days in filing of the captioned appeal.

4. Issue notice. Learned APP for the State accepts notice and submits that he has no objection if the present application is allowed.

5. For the reasons stated therein, as also in view of the period for which condonation of delay is sought and the no objection given by the learned APP, the present application is allowed and the delay of 15 days in filing of the captioned appeal is condoned.

By virtue of the present appeal under Section 415(2) read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the appellant seeks setting aside of the judgment on conviction dated 01.11.2025, as also the order on sentence dated 04.11.2025, passed by the learned Additional Sessions Judge (SC-POCSO)-01, West District, Tis Hazari Courts, Delhi (learned Trial Court) in SC No.662/2022 arising out of FIR No.519/2022 registered at PS.: Punjabi Bagh under Section 377 of the Indian Penal Code, 1860 (IPC) and Section 6 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act), whereby he has been found guilty of the alleged offences and sentenced to undergo rigorous imprisonment for a period of Twenty five (25) years alongwith fine of Rs.10,000/-, in default whereof, to undergo simple imprisonment for a period of six months for offence under Section 6 of the POCSO Act; and to undergo rigorous imprisonment for a period of two years alongwith fine of Rs.2,000/-in default whereof, to undergo simple imprisonment for a period of three months for offence under Section 506 of the Indian Penal Code, 1860. All sentences to run concurrently.

8. Issue notice. Learned APP for State accepts notice.

9. For the reasons stated therein, Admit.

10. Let TCR be requisitioned in the digitised form from the learned Trial Court within a period of four weeks.

11. List this appeal in due course in the category of ‘Regulars’ as per the year of its seniority.

CRL.M.(BAIL) 327/2026 (for suspension of sentence)

12. By virtue of the present application under Section 430 read with Section 528 of the BNSS, the appellant seeks suspension of sentence during the pendency of the present appeal.

13. Learned counsel for the appellant submits that the appellant has already undergone a substantial period of sentence out of the total sentence awarded to him.

14. Issue notice. Learned APP for the State accepts notice. He seeks, and is granted, a period of four weeks to file the Status Report precisely mentioning the period of sentence already undergone by the appellant out of the total sentence awarded to him.

15. Keeping in view the nature of the facts and disputes involved, the parties are hereby called upon to file their respective written synopsis instead of reply/ rejoinder not exceeding three pages, giving a chronological list of dates and events and relevant documents, if any, alongwith duly highlighted judgments setting out the propositions of law therein, they wish to rely upon within a period of four weeks.

16. Let the latest Nominal Roll of the appellant be also requisitioned from the concerned Jail Superintendent within the aforesaid period of four weeks.
