1. These are petitions filed under Article 226 of the Constitution of India raising identical issues that is the rights of Economically Weaker Section (“ EWS ”) category students studying in respondent No. 2 school.

2. It is the case of the petitioners that being EWS category students, they are entitled to continue their studies up to Class XII under the Right of Children to Free and Compulsory Education Act, 2009. In the past, interim orders have been passed permitting the petitioners to continue their studies.

3. Ms. Surbhi, learned counsel for the respondent No.2, states that the issue with regard to charging of fee from EWS category students is pending before the Division Bench.

4. However, the Court cannot permit the academic careers of the petitioners to be interdicted on account of late submission of the EWS certificate. Thus, it is directed that till the issue is decided, the petitioners shall continue to study in the respondent No. 2 and the respondent No.2 shall not charge any fee. As and when the issue is decided by the Division Bench, the petitioners shall be bound by the same subject to availing their legal rights in accordance with law.

5. Further, the petitioners shall submit their EWS Category certificate expeditiously and not later than 4 months from today.

6. Since the exams are commencing from 17.02.2026, the admit cards shall be handed over to the petitioners today itself.

7. The petition is disposed of in aforesaid terms.

8. Next date of hearing, i.e. 24.04.2026 stands cancelled.
