1. This application under Section 430 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the accused in Sessions Case No. 802 of 2017 on the file of Additional Sessions Judge-01 (POCSO) North West, Rohini District Courts, Delhi, seeking suspension of sentence during pendency of the appeal. As per the impugned judgment, the appellant/ accused has been found guilty of the offences punishable under Sections 354C IPC, Section 12, 13 & 14 POCSO Act. He has been sentenced to varying terms of imprisonment for the aforesaid offences and the sentences have been directed to run concurrently. The maximum period of sentence that the appellant will have to undergo is for a period of 5 years.
