1. This is an application on behalf of the plaintiff seeking exemption from filing legible copies and originals of the documents.

2. The application is allowed, subject to the plaintiff granting inspection of the documents, as and when, he is required to do so, or filing the original documents at the stage of admission/denial.

3. The application stands disposed of.

4. The plaint be registered as suit.

5. On filing of process fee, summons be issued to the defendants by all permissible modes.

6. Let written statement to the plaint be filed by the defendants within a period of thirty days. The defendants shall also file an affidavit of admission/denial of the documents filed by the plaintiff, failing which the written statement shall not be taken on record.

7. The plaintiff is at liberty to file replication thereto within thirty days after filing of the written statement. The replication shall be accompanied by affidavit of admission/denial in respect of the documents filed by the defendant, failing which the replication shall not be taken on record.

8. It is made clear that any unjustified denial of documents may lead to an order of costs against the concerned party.

9. Any party seeking inspection of documents may do so in accordance with the Delhi High Court (Original Side) Rules, 2018.

10. List before the learned Joint Registrar for completion of service, pleadings, admission/denial of documents and marking of exhibits on

07.05.2026.

11. List before Court after completion of pleadings, on the date to be assigned by the learned Joint Registrar.

12. The present suit has been filed by the plaintiff inter alia seeking declaration to the effect that the two sale deeds dated 16.06.2021 and 30.07.2021 executed by the defendant no. 4 in favour of defendant nos. 1 to

3 as null and void.

13. Further prayer has been made for a decree of partition of the suit property i.e. property bearing Municipal No. 2628, Ward No. XVI, Plot No.1400/246, Situated in Block M, Gali No.4, Beadonpura, Bank Street, Karol Bagh, New Delhi-110005 (hereinafter the ‘suit property’).

The case set out in the plaint is that the plaintiff, plaintiff’s mother and his two brothers, who have been arrayed as defendant nos. 5 & 6, purchased the Ground Floor of the suit property along with 50% undivided share in the land underneath from the erstwhile owner Sh. Kewal Krishan Bahl vide four separate sale deeds, executed on 11.08.1989 thereby each acquiring 1/4^th undivided share of the entire ground floor along with 1/8^th undivided share in the land rights.

Subsequently, the plaintiff, his mother and his two brothers i.e. defendant nos. 5 and 6 purchased the first floor, second floor and terrace/roof rights of the suit property along with 50% undivided share in the land underneath from the erstwhile owner Smt. Ramesh Kumari Bahl vide four separate sale deeds, executed on 07.03.1994 thereby acquiring 1/4^th undivided share in the first floor, second floor and terrace/roof rights along with 1/8^th undivided share in the land underneath the suit property.

16. The plaintiff vide registered sale deed dated 13.12.1996 sold his 1/4^th undivided share in the ground floor to defendant no. 4. Thereafter, on a representation made by the defendant no. 4 to the plaintiff that there are some discrepancies with regard to the earlier sale deed dated 13.12.1996, plaintiff on the pretext of correction of the earlier sale deed, got executed another sale deed dated 31.12.1996 for transferring the portion which was already sold vide
