1. The present petition alleges wilful disobedience/ non-compliance of the directions contained in the order dated 20.09.2024 passed by this Court in W.P.(C) 13264/2024. The operative directions in the said order read as under:-
2. In terms thereof, the concerned Executive Magistrate was directed to decide the detailed representation of the petitioner under Section 152 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The said representation of the petitioner was in the light of the petitioner’s grievance that there is unhygienic sewage and waste discharge in the locality where he resides.
3. A status report is stated to have been filed by the respondents, however, the same is not on record. Let the same be brought on record before the next date of hearing.
4. It is submitted by learned counsel for the respondents that as per the report submitted by the Delhi Jal Board (DJB) to the respondent no.1, as on date there is no sewage and waste discharge around the premises or in the locality where the petitioner resides. However, the same is refuted by the petitioner, who appears in person.
5. Considering the nature of the controversy, the DJB and Municipal Corporation of Delhi are impleaded as respondent nos. 7 and 8 respectively in the present petition.
6. Let an amended memo of parties be filed by the petitioner within a period of one week from today.
7. It is directed that a joint fresh inspection of the concerned area be carried out by the concerned officials of the DJB, MCD and the SDM in the presence of the petitioner. The petitioner shall draw attention to the areas where sewage/ water discharge has accumulated and photographs of such location/ s shall also be taken during the said inspection. The officials of the respondents shall ensure that appropriate immediate remedial action/s is immediately taken, as may be warranted upon the aforesaid inspection being conducted.
8. Let the said inspection be conducted within a period of two weeks from today. Let requisite remedial action be also taken within a period of eight weeks thereafter.
9. The concerned officials of the Delhi Jal Board, Municipal Corporation of Delhi and the SDM are directed to file a status report before the next date of hearing.
