1. The instant petition is for the following reliefs:-
“a) In view of the above, it is most respectfully prayed that this Hon’ble Court may be pleased to issue appropriate direction to Respondent No.2 Divisional Commissioner (North-West) to decide Appeal No. 1042/2024 titled “Silki Kaur v. Gurdeep Singh Mehta & Anr along with pending Stay Application within a time-bound period, as may be fixed by this Hon’ble Court; and b) Direct the Respondent no.3 to move out of the property of the Petitioner till the disposal of the Appeal no. 1042/2024 titled “Silki Kaur v. Gurdeep Singh Mehta & Anr c) Pass such other and further orders as this Hon’ble Court may deem fit in the interests of justice.”

The facts of the instant case would indicate that on 02.06.2022, the petitioner filed a complaint before the Senior Citizen Cell, District North- West, Delhi, seeking eviction of his son i.e. respondent no.4 herein, and daughter-in-law i.e. respondent no.3 herein from his residential property. Thereafter, the District Magistrate (North-West), Delhi vide order dated 26.09.2024, directed for eviction of respondent no.3 from the residence of the petitioner. Subsequently, respondent no.3 challenged the said order in an appeal before the Divisional Commissioner i.e. respondent no. 2 herein. Respondent no.3 has also filed an interim application seeking a stay and has also filed a writ petition praying for stay on the operation of the original order, whereby, her eviction was directed. The Court disposed of the said petition i.e. W.P.(C) 15504/2024 vide order dated 07.11.2024, directing the operation of the original order to be stayed. It was also directed that till the matter is decided, the order of eviction shall remain stayed.

It is the case of the petitioner that the matter was taken up for consideration before the Divisional Commissioner on various dates i.e. 22.11.2024, 18.12.2024, 10.01.2025, 19.02.2025, 09.04.2025, 18.06.2025, 29.08.2025, 31.10.2025. The order dated 18.06.2025 indicates that the petitioner’s arguments were heard. The order dated 29.08.2025 further reflects that the arguments of respondent no.3 were also heard. Thereafter, on 31.10.2025, the matter got adjourned. The petitioner, therefore, contends that an application for urgent hearing was filed, which remained pending.
4. Having considered the overall facts and circumstances, the Court finds that the original order dated 26.09.2024 has not been given effect to by virtue of the order passed by this Court. The appeal filed by respondent no.3 is pending for a significant amount of time.
5. It is, therefore, directed that respondent no.2- Divisional Commissioner shall decide the said appeal along with the pending application within a period of six weeks from the date of receipt of copy of the order passed today.
6. With the aforesaid observations and directions, the instant petition stands disposed of.
7. All rights and contentions of the parties are left open.
