1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:

“a. issue a writ of Mandamus or any other appropriate writ, order or direction, directing the Respondents, particularly Respondent No.1 and Respondent No.3, to forthwith issue the Class XII Board Examination Admit Card to the Petitioner and permit the Petitioner to appear in the Board Examinations commencing from 17.02.2026, provisionally and subject to the final outcome of the present writ petition;

b. Issue a writ of Certiorari or any other appropriate writ, order or direction, quashing and setting aside the impugned communication/letter dated 10.02.2026 (received on 11.02.2026) issued by Respondent No.1, whereby the Class XII Board Examination Admit Card of the Petitioner has been withheld;...”

2. The case of the petitioner is that the petitioner is a student suffering from moderate depressive order and anxiety disorder and has been undergoing psychiatric and therapeutic intervention.

3. Mr. Nanda, learned counsel for the petitioner states that the petitioner has been debarred from appearing in his Class 12^th examination without providing any hearing. He further states that without prejudice to the rights, the petitioner may be permitted to participate in tomorrow’s examination.

4. For the said reasons, issue notice.

5. Mr. Khanna, learned SC, accepts notice on behalf of respondent No.

1. Mr. Singh, learned counsel, accepts notice on behalf of respondent No. 2.

6. A perusal of the documents on record shows that the petitioner has zero attendance.

7. Since the petitioner is having zero attendance and despite the certificate dated 04.11.2025, wherein the petitioner was declared fit to resume his studies and appear for examination, the petitioner has not approached the Court any time from 04.11.2025 till today, nor attended the school. In view of this, I am unable to permit the petitioner to appear for tomorrow’s examination.

However, since the petitioner has not been heard, it is directed that the Chairman/Deputed Officer will hear the petitioner and/or his counsel/representative on 20.02.2026 at 11:30 AM at CBSE headquarter at Integrated Office Complex, Sector 23, Phase I, Dwarka and take into consideration the supporting documents and pass a speaking order.

9. The petition is disposed of with the aforesaid directions.
