1. The present suit has been filed seeking partition of the suit property bearing no. C-575, Gali no. 12, Majlis Park, Delhi-110033 admeasuring 91.5 Sq. yards (hereinafter referred to as the suit property).
2. It is the pleaded case of the plaintiff that the plaintiff, as well as, defendant nos.1 and 2 are the daughters of Sh. Chander Prakash.
3. The defendant no. 3 is a third party with whom defendant no. 1 had allegedlyentered into an Agreement to Sell.
4. It is the case of the plaintiff that late Sh. Chander Prakash died intestate on 01.12.2017 without leaving any Will, hence, the plaintiff alongwith her two sisters i.e. defendant no. 1 and 2 are entitled to 1/3rd share each in the suit property.
