O R D E R

1. Heard learned counsel for the parties.

2. This public interest litigation petition seeks a direction to be issued to respondent no.1-MCD for taking action against illegal and unauthorised constructions, including the action of stopping the construction, sealing the illegal construction and taking demolition action, in respect of the five properties mentioned in paragraph 8 of the instant writ petition.

3. Learned counsel representing the respondents has stated that in respect of all the five properties some action has been initiated, which is continuing and shall be completed at the earliest.

In respect of House No.28, Khasra No.26/14/0 and 26/17/0, D-Block, Bharat Vihar, it has been stated that the property has been booked under Sections 344(1) and 343 of the Delhi Municipal Corporation Act, 1957 (‘Act, 1957’) and a Show Cause Notice has also been issued to the owner/builder. He has further stated that a demolition order has been passed on 24.10.2025 and further that a notice has been issued for stopping the work to the S.H.O. P.S. Sector 17, Dwarka on 17.09.2025.

5. In respect of Plot No.175, 176 and 177 Ambika Enclave, Kakrola, New Delhi, it has been stated that the said property has been booked under Sections 344(1) and 343 of the Act, 1957 on 28.08.2024 and a work stop notice has also been issued to the S.H.O. concerned.

6. Similarly, in respect of Plot No.134-A, Vikas Nagar, Kakrola, New Delhi, as per the submissions made by the learned counsel for the respondent no.1-MCD, similar actions have been taken. Regarding rest of the two properties mentioned in paragraph 8 of the writ petition, some action has been taken.

7. Learned counsel for the respondent no.1-MCD has submitted details of the action taken in respect of all the aforementioned properties, which is taken on record, relevant portion of which is extracted herein below:

In view of the aforesaid, what we find is that action has been initiated in respect of the properties mentioned in paragraph 8 of the writ petition and therefore, we dispose of the instant writ petition with a direction to the respondent no.1-MCD to conclude the action taken in accordance with law.

9. We further direct that if any request in respect of these properties has been made to the S.H.O, Delhi Jal Board, electricity supply companies or any other authority by the respondent no.1-MCD, the same shall also be attended to and appropriate action which may be warranted under law shall also be taken. Non-compliance of this order will be viewed seriously.

10. Learned counsel for respondent no.1-MCD is requested to communicate this order to all other authorities including Delhi Jal Board, electricity supply company and the S.H.O. concerned, as well.

11. The instant writ petition stands disposed of.
