1. This hearing has been done through hybrid mode.

2. The present petition has been filed by the Petitioner under Article 226 and 227 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondent No.1- Registrar Cooperative Society (hereinafter, ‘RCS’) to quash and set-aside the election notice dated 28th January, 2026 issued by the Mr. Bijender Singh Kardam i.e., the Returning Officer (hereinafter, ‘RO’).

3. The case of the Petitioner is that he is a member of the Prabhavi CGHS Ltd. (hereinafter, ‘Society’) situated at Plot No. 29B, Sector- 10, Dwarka, Delhi-110075.

4. The elections for the Managing Committee of the Society were called earlier on 28th April, 2024. However, the same were cancelled by the RO in view of the fact that three members were disqualified.

5. Thereafter, a fresh election agenda was issued on 28th May, 2024 by the then RO namely, Mr. Bal Kishan Chhilwar. The Petitioner then filed certain right to information applications as also representations before the Society and the RCS. The said representations, according to the Petitioner, have not received a closure and no action has been taken by the RCS or the Society.

6. Recently, it is submitted that on 28th January, 2026, a fresh election agenda i.e., the impugned election notice has been called by the RO namely, Mr. Bijender Singh Kardam.

7. The submission of ld. Counsel for the Petitioner is that certain candidates who deserve to be disqualified are being permitted to contest in the elections of the Managing Committee of the Society and hence, this petition prays that the impugned election notice be quashed and a fresh list of eligible members be prepared by the RO.

8. Ms. Mohan, ld. Counsel for RCS, submits that in respect of the representations given by the Petitioner, the RCS had already called for information and records from the Society and that the RCS would proceed in accordance with law.

9. The grievance of the Petitioner is that the Petitioner is not aware of any steps taken by the RCS, which is denied by Ms. Mohan, ld. Counsel on the ground that Petitioner had been marked in the communications issued to the Society for the correspondence.

10. Be that as it may, the Court notices that since 2024, no elections have taken place in the Society. In the opinion of this Court, no Society can be administered without a proper Managing Committee. The RCS ought to proceed as per the Act and Rules and the Society ought to appoint the RO, which it has duly done. The RO has called the elections and the agenda has already been finalised. The nominations have also all been finalised. The final list would also have been displayed as the date for the same was 17th February, 2026 i.e., yesterday. The elections for the Managing Committee of the Society are to be held on 22nd February, 2026, which is the coming Sunday.

11. In the opinion of this Court, the elections to the Managing Committee of the Society do not deserve to be interfered with. If the Petitioner has any grievance in respect of the candidature of any candidates, the Petitioner is free to avail of his remedies in accordance with law, after the conclusion of the elections.

12. Needless to add, the RCS shall decide the representations of the Petitioner expeditiously and in any case within a period of three months.

13. The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
