1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-

“a. Direct the Respondent No.1 and 2 to remove illegal encroachments/unauthorized constructions/ slum clusters on the DDA land in front of AO Block, Shalimar Bagh, Delhi;

and/or b. Direct the Respondent No. 2 and 3 and to clear the service road connecting foot over bridge near Prem Bari underpass to the Kendriya Vidyalaya, Shalimar Bagh, Delhi in front of the said encroachments/illegal constructions on the DDA land in front of AO-Block, Shalimar Bagh, Delhi, and ensure that the length and width of the said service of road is as per the records; and/or c. Direct the Respondent No.2 to clear the garbage, filth and waste from the DDA land in front of AO-Block, Shalimar Bagh, Delhi and from the service road connecting foot over bridge near Prem Bari underpass to the Kendriya Vidyalaya, Shalimar Bagh, Delhi on a regular basis to maintain proper cleanliness and hygiene; and/or d. Direct the Respondent no. 2 and 6 to prevent carrying out any further unauthorized and illegal constructions/encroachments on the DDA land in front of AO- Block, Shalimar Bagh, Delhi or on the service road connecting foot over, bridge near Prem Bari underpass to the Kendriya Vidyalaya, Shalimar Bagh, Delhi; and/or e. Direct the Respondent no. 6 to ensure assistance and co- operation with the respondent no. 1 to 3 in removing the unauthorized and illegal constructions/encroachments on the DDA land in front of AO-Block, Shalimar Bagh, Delhi or on the service road connecting foot over bridge near Prem Bari underpass to the Kendriya Vidyalaya, Shalimar Bagh, Delhi.;

and/or f. Direct the Respondent No. 4 and 5 to prepare a scheme for resettlement of slum dwellers at said DDA land in front of AO Block, Shalimar Bagh, Delhi;...”

2. Pursuant to the order dated 04.01.2024, a meeting was convened on

31.01.2024 in compliance of the said order. The minutes of the meeting read as under:-

3. Even after a period of more than 2 years, there is no change in ground reality. The same is evident from the photographs on record.

4. The respondent Nos. 1 to 4 and 6 shall ensure that the decisions taken in the meeting dated 31.01.2024, as reflected above in point Nos. 1 to 5, are complied with. The needful shall be done expeditiously and in any case, not later than 6 weeks from today.

5. The road shall be repaired within 4 weeks thereafter and be maintained by the PWD.

6. The respondent No.6 shall personally ensure that the gate providing ingress and egress to the members of the society as well as the service lane are always accessible and is kept encroachment-free.

7. In case there is non-compliance of the order, the petitioner shall be entitled to file a contempt petition.

8. The compliance report shall be submitted to the Court as well as to the learned counsel for the petitioner.

9. The petition is disposed of in the aforesaid terms.

10. The documents handed over in Court today are taken on record.
