1. Allowed, subject to all just exceptions.

2. The present writ petition has been filed seeking a direction to the respondent no.1 to demolish the unauthorised construction carried out by the respondents no.4 to 7 at property bearing House numbers 146, 148, and 150, Site-2, Vikas Puri, New Delhi.

3. Further direction is sought directing the respondent no.2 to provide the correct site plan of the property of the respondents no.4 and 5 (House no. 150, Site-2, Vikas Puri, New Delhi) to the respondent no.1/ MCD so that the extent of unauthorised construction may be determined.

4. Earlier, a writ petition, being W.P.(C) 8109/2025, was filed on behalf of the petitioner, which was disposed of by this Court vide order dated 11^th September, 2025, taking note of the status report filed on behalf of MCD stating that MCD has initiated action against the unauthorised construction.

5. The grievance of the petitioner is despite the aforesaid order having been passed, no action has been taken by the respondent no.1/ MCD.

6. Issue notice.

7. Notice is accepted on behalf of the respondents.

8. Counsel appearing on behalf of the respondent no.3/ STF submits that the petitioner’s complaint has been registered and the same has been forwarded to MCD for appropriate action.

9. Counsel appears on behalf of the respondent no.1/ MCD through video conferencing and has connectivity issues.

10. Status report be filed on behalf of the respondents no.1 to 3 within four (4) weeks from today.

11. Counsel appearing on behalf of the respondents no.4 to 7 submits that there is unauthorised construction in the petitioner’s property as well, which is disputed by counsel for the petitioner.

12. In view of the above, the status report to be filed by MCD shall also deal with the aspect of unauthorised construction, if any, in the petitioner’s property.

13. Counter affidavit(s) be filed on behalf of the respondents no.4 to 7 within two (2) weeks.

14. In the meanwhile, the respondent no.1/ MCD shall ensure that no unauthorised construction be carried out in the subject properties. Further, a direction is issued to the respondent no.2/ DDA to supply the sanction plan of the subject properties to MCD within two (2) weeks from today.

15. List on 11^th May, 2026.
