CRL.M.A. 6025/2026 By way of the present application filed under section 5 of the Limitation Act 1963, the petitioner seeks condonation of about 112 days’ delay in filing the petition.
2. For the reasons stated in the application, which is not opposed, the delay is condoned.
3. The application is allowed.
4. The petition is taken on Board.

5. By way of the present petition filed under sections 438/440/442 read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 read with section 147 of Negotiable Instruments Act, 1881, the petitioner inter-alia impugns judgment dated 31.07.2025 passed by the learned Additional Sessions Judge-07, Shahdara District, Karkardooma Courts, Delhi in appeal bearing CA No. 165/2023.
6. Issue notice.
7. Learned counsel appears for the respondent on advance copy; accepts notice; and seeks time to file reply.
8. Let reply be filed within 06 weeks; rejoinder thereto, if any, be filed within 04 weeks thereafter; with copies to the opposing counsel.
9. Learned counsel appearing for the parties jointly submit that the parties have settled the matter; and the respondent does not oppose the prayer made in the present revision petition.
10. In view of the above, the parties are directed to remain present in court on the next date of hearing.
11. Re-notify on 05th May 2026.
12. In the meantime, considering the nature of the case, the custodial sentence of 01 year awarded to the petitioner vidé sentencing order dated 25.08.2023 passed by the learned Metropolitan Magistrate-04, Shahdara District, Karkardooma Courts, Delhi, of which the petitioner has already undergone about 07 months, shall remain suspended, till the next date of hearing before this court, on the following conditions:
12.1. The petitioner shall furnish a personal bond in the sum of Rs.
25,000/-(Rs. Twenty-Five Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the learned trial court;
12.2. If the petitioner has a passport, he shall surrender the same to the Jail Superintendent and shall not travel out of the country without prior permission of this court.
13. A copy of this order be sent to the concerned Jail Superintendent forthwith.
