By way of the present appeal filed under section 415 of the Bharatiya Nagarik Suraksha Sanhita 2023 (‘BNSS’), the appellant seeks setting-aside of judgment dated 26.12.2025 and order on sentence dated 12.01.2026 passed by the learned Special Judge, (PC Act) (CBI) (Coal Block Cases)-02, Rouse Avenue District Courts, New Delhi in CBI Case No.299/2019.

3. Mr. R.S. Cheema, learned senior counsel appears for the respondent/CBI on advance copy; accepts notice; and seeks time to file reply in CRL.M.A. No. 6146/2026.

4. Let reply to CRL.M.A. No. 6146/2026 be filed within 04 weeks;

rejoinder/response thereto, if any, be filed before the next date; with copies to the opposing counsel.

5. Let Trial Court Record be requisitioned in electronic form; let appeal paper-book be prepared; and let a copy of the paper-book be supplied to both counsel on request.

CRL.M.(BAIL) 425/2026

7. By way of the present application filed under section 430 of the BNSS, the appellant seeks suspension of sentence imposed vidé order dated 12.01.2026, during the pendency of the present appeal.

8. Issue notice.

9. Mr. R.S. Cheema, learned senior counsel appears for the respondent/CBI on advance copy; accepts notice; and does not oppose suspension of sentence.

10. Fine of Rs. 10 lacs is stated to have been paid.

11. Accordingly, the sentence imposed upon the appellant vidé sentencing order dated 12.01.2026 shall remain suspended during the pendency of the appeal subject to the following conditions:

11.1. The petitioner shall furnish a personal bond in the sum of Rs.1,00,000/- (Rs. One Lac Only) with 01 surety in the like amount from a family member, to the satisfaction of the Jail Superintendent;

11.2. The petitioner shall furnish to the CBI, EO-1, New Delhi a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

11.3. If the petitioner has a passport, he shall surrender the same to the Jail Superintendent and shall not travel out of the country without prior permission of this court;

11.4. The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending matter.

12. A copy of this order be sent to the concerned Jail Superintendent forthwith.

13. The application stands disposed-of.
