1. This is a writ petition filed under Article 226 read with Article 227 of the Constitution of India seeking the following prayers:-
“(a) Issue a writ of Certiorari or any other appropriate writ, order or direction quashing and setting aside the impugned order dated 06.01.2026 passed by Respondent No. 1 (Reserve Bank of India - Ombudsman) in Complaint No. N202526023366130;
(b) Issue a writ of Mandamus or any other appropriate writ, order or direction directing Respondent No.2 to strictly comply with and give effect to the RBI Circular No. DBR.No.Leg.BC.78/09.07.005/2017-18 dated 06.07.2017 on Customer Protection - Limiting Liability of Customers in Unauthorized Electronic Banking Transactions, and accordingly limit/absolve the Petitioner from liability arising out of the unauthorized electronic transactions amounting to ₹3,81,509/-;
(c) Issue a writ of Mandamus or any other appropriate writ, order or direction directing Respondent No.2 to:
(i) reverse and cancel the fraudulent debits of ₹3,81,509/-;
(ii) refund all interest, late payment charges and other incidental charges levied thereon;
(iii) restore the Petitioner's credit card account to the status as existing on 22.06.2025; and (iv) not report or remove any adverse credit information relating to the disputed transactions from credit bureaus;
(d) Award compensation of ₹5,00,000/- (Rupees Five Lakhs only) to the Petitioner for mental agony, harassment and damage to reputation caused due to illegal actions of Respondent No.2 and the arbitrary order passed by Respondent No. 1;
(e) Award costs of the present proceedings in favour of the Petitioner;…”
2. The present petition has been filed challenging the order dated
06.01.2026 passed by the respondent No. 1 i.e. the Ombudsman, Reserve Bank of India, wherein the complaint of the petitioner against the respondent No. 2 has been closed.
3. It is stated by Mr. Atrey, learned counsel for the petitioner that the Ombudsman failed to take in to account that the petitioner was a victim of the cyber fraud and the one time password (OTP) was not shared consciously.
4. For the said reasons, issue notice.
5. Mr. Sharma, learned counsel accepts notice on behalf of the respondent No.1 and states that he will file a counter affidavit within
2 weeks from today.
6. Let notice be issued to the respondent No. 2 through all modes including electronic on the petitioner taking steps within 1 week from today, returnable on 28.04.2026.
