1. CS(OS) 561/2023 is a suit for recovery, having been filed on behalf of the plaintiffs, wherein, the plaintiff no. 2 is the wife of deceased Sh. Jarnail Singh, and plaintiff no. 1 is the minor son of plaintiff no. 2 and deceased Sh.
Jarnail Singh.
2. The suit for recovery has been filed, as despite issuance of the Succession Certificate in favour of the plaintiffs, the defendant nos. 1 to 9, withdrew money from the bank accounts of late Sh. Jarnail Singh. The defendant no. 1 is the brother of late Sh. Jarnail Singh and the other defendants are family members/friends of late Sh. Jarnail Singh.
3. Learned counsel appearing for the plaintiffs in CS(OS) 561/2023 draws the attention of this Court to the order dated 29th March, 2023, passed by the Succession Court in Case No. 39/2022, titled as “Lavleen Ahluwalia And Anr. Vs. State Govt. of NCT of Delhi And Ors.”, wherein, the Succession Certificate has been granted in favour of the plaintiffs herein. The order dated 29th March, 2023 recording the fact of issuance of Succession Certificate in favour of the plaintiffs, is reproduced herein:
“
”4. The relevant portions of the judgment dated 29th March, 2023, passed by the Succession Court, in the same case bearing No. 39/2022, by which Succession Certificate has been granted in favour of the plaintiffs, are as follows:

Accordingly, it is clear that a Succession Certificate has been duly granted in favour of the plaintiffs, though this Court is informed that an appeal has been filed by defendant no. 1 in CS(OS) 561/2023, against the aforesaid judgment/order granting Succession Certificate in favour of the plaintiffs. The said appeal is stated to be pending before the District Court, Tis Hazari Courts.
6. This Court further notes the order dated 20th September, 2023 passed by this Court, wherein, direction was issued by this Court to maintain status quo with regard to the two residential properties from the estate of late Sh.
Jarnail Singh, in the following manner:

6. Taking into account that it is the plaintiffs' case that despite a successioncertificate qua the estate oflate Sh. Jarnail Singh having been issued in their favour, the defendants, in order to wrongfully deprive the plaintiffs of their rightful dues unauthorisedly operated hisbankaccounts,Iamofthe viewthattheplaintiffshave beenable to make out a case for directing the defendants to maintain status quo qua the two residential properties as mentioned in para 8 of the application being House No. T-510/F, 15, C-IB, Gall No. 4, Baljit Nagar,DelhiandHouse No.C-200A,ThirdFloor,HariNagar,New Delhi-110064. The balance of inconvenience is also in the favour of the plaintiffs. Grave and irreparable prejudice would be caused to the plaintiffs in case the defendants proceed to create third party rightsintheaforesaidtwosuitproperties xxxxxxxxx”
