1. Allowed, subject to all just exceptions.

W.P.(CRL) 724/2026

2. The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking for the following directions:

“a) Issue an appropriate writ, order or direction declaring that the arrest and custodial interrogation of the Petitioner stand vitiated on account of the admitted non- compliance with the binding directions issued by the Hon’ble Supreme Court in ‘Paramvir Singh Saini vs. Baljit Singh & Ors., (2021) 1 SCC 184’ and reiterated in ‘In Re: Lack of Functional CCTVs in Police Stations’, inasmuch as no functional CCTV cameras were installed at the concerned police establishment and no report of the Petitioner’s arrest and interrogation was forwarded to the District Level Oversight Committee as mandatorily required and in furtherance of compliance affidavits filed before this Hon’ble Court as well as Hon’ble Apex Court;

b) Issue an appropriate Writ, order or direction holding that failure to adhere to the aforesaid mandatory safeguards constitutes a violation of the Petitioner’s fundamental rights guaranteed under Articles 21 and 22 of the Constitution of India;

c) Issue an appropriate Writ, Order or direction commanding the Respondents to produce the records demonstrating compliance with the reporting requirement prescribed by the Hon’ble Supreme Court for arrests and interrogations conducted during periods when CCTV cameras are non-

functional or unavailable;

d) In the absence of such record, issue appropriate directions for an independent inquiry into the circumstances surrounding the Petitioner’s arrest and custodial interrogation;

e) Issue appropriate writ(s), order(s) or direction(s) directing the Respondents to ensure strict and time-bound compliance with the directions of the Hon’ble Supreme Court regarding installation, maintenance and oversight of CCTV systems in all police stations and investigative offices within the jurisdiction of this Hon’ble Court;

f) Issue appropriate writ taking action against the erring officials who gave false affidavits regarding compliance of Paramvir’s directions before the Division bench, Coordinate bench of this Hon’ble Court.

g) Issue such further directions as may be deemed appropriate to safeguard transparency and accountability in custodial practices so as to prevent recurrence of similar violations affecting citizens at large.”

4. Notice is accepted by the learned counsels for the respective respondents.

5. Reply be filed within a period of three weeks from today. Rejoinder thereto, if any, be filed within a period of two weeks thereafter.
