1. This petition has been filed with the following prayers:-

“I. Issue a writ, order or direction(s) to the Respondent Authorities in the nature of mandamus or any other appropriate writ quashing and setting aside the impugned Office Order bearing S. No. 42099/CSIF/TAJ/CO/Admin/2026-748 dated 07.02.2026 whereby the Petitioner has been transferred/relieved from Taj Mahal Unit, Agra to DHEP Dulhasti; AND/OR II. In the alternative, and without prejudice to prayer (a) above, issue a writ, order or direction in the nature of mandamus or any other appropriate writ directing the Respondents to forthwith revoke/cancel the impugned transfer order and allow the Petitioner to continue/remain posted at Taj Mahal Unit, Agra until completion of the minimum prescribed tenure of 3 years as per the prevailing transfer guidelines;”

2. In effect, the petitioner is challenging the order passed by the respondents transferring the petitioner from Agra to DHEP Dulhasti. According to the learned counsel for the petitioner that during the entire service career, the petitioner had rendered service at various places including the extremely remote and difficult areas, all of which are located far away from his home town resulting in prolong absence from his family. He states that the petitioner has been posted in Agra only 10 months back and his transfer from Agra to DHEP Dulhasti is clearly arbitrary.

3. We have heard the learned counsel for the parties at length. It transpired that while the petitioner was posted at Agra, a charge-sheet was issued to the petitioner involving allegations regarding sharing of address of Force Headquarter with another Force member, which resulted in a penalty of punishment of reduction of pay by one stage from Rs. 56,900/- to Rs. 55,200/- in the pay matrix of 7th CPC for a period of one year without cumulative effect and not adversely affecting his pension. During the course of hearing, our attention has been drawn to a communication sent by the Assistant Inspector General – North Sector-I wherein a reference has been made to the proceedings against the petitioner and also seeking transfer of three personnel including the petitioner out of Agra.

4. We have perused the letter dated 23.01.2026. Insofar as the petitioner is concerned, the following is stated:-

“iv) On dated 14.10.2025, a pseudonymous letter, containing allegations devoid of any factual basis, was posted for CISF HQrs. The matter was subsequently taken up for enquiry by the higher formation. During the investigation, it was established that CISF NO. 034700141 SI/Exc Shyam Veer Singh and CISF NO.104853319 CT/GD Mukesh Kumar, both deployed at the CISF Unit, Taj Mahal, Agra, planned the posting of the letter. They misled and used a civilian, Mausim, a local resident of Agra, for this purpose. The two CISF personnel used him to conceal their identities and also provided him with the required amount for postage. Involving civilians in official correspondence- especially in matters involving serious allegations-can have adverse implications for the department. During investigations, if such individuals are called upon, it may project an unfavorable image of the force. Such actions can undermine the integrity of the unit and the public trust in its functioning. Being a force that continuously operates in the public domain, the CISF is particularly sensitive to such activities, as they not only undermine public trust but also adversely affect the overall functioning and efficiency of the force.
